유럽에서 온라인수색과 암호통신망 EncroChat 사건

국문 초록

엔크로챗(EncroChat)은 텔레그램과 같은 비밀 암호통신시스템이다. 이 암호통신시스템을 통해서 마약거래 등 범죄관련 정보들이 유통되었다. 프랑스와 네덜란드 합동수사팀은 이 암호통신망의 암호를 해독하여 여기서 유통되는 범죄관련 정보들을 수집하였다. 여기에 사용된 수사기법이 ‘온라인 수색’이다. 최근 온라인수색에 관한 국민들의 관심이 고조되고 있다. 따라서 온라인수색제도를오래전에 도입한 국가들이 온라인수색을 어떻게 운용하고 있는지 그리고 이로 인하여어떤 문제들이 제기되고 있는지 살펴보는 것은 이제 도입론을 논의하고 있는 우리에게 상당한 의미를 가진다. 암호통신망을 통하여 마약, 불법무기거래 등이 조직적으로 비밀리에 행해지고 있는상황에서 이러한 통신망에 접속하지 않고서는 암호통신망을 이용한 범죄에 제대로대응할 수가 없다. 이를 해결하는 방법 중 하나가 온라인수색이다. 유럽에서는 오래전에 이러한 온라인수색이 도입되어 시행되고 있고 판례도 축적되고 있다. 온라인수색 도입 시 다양한 부수처분 이용과 전기통신사업자의 협조의무, 암호통신감청과 온라인수색의 구분은 우리 입법에서 고려해야 할 것이다. 하지만 휴대전화암호통신망 EncorChat 사건은 현재 유럽에서 다양한 법적인 문제를 야기하고 있다. 온라인수색이 야기하는 다양한 법적인 문제도 함께 고려하여야 할 것이다.

영문 초록

EncroChat is an encrypted communication system like Telegram. It w as used to distribute criminal information such as drug trafficking. The Europol-supported JIT in France and in the Netherlands decrypted the encrypted communication network and collected criminal information dist ributed on it. The investigative technique used is called ‘covert online s earch’. There has been a lot of public interest in online searches lately. The refore, it is important to look at how countries that introduced online s earch systems a long time ago are operating them and what issues they are raising. The trade in drugs and illegal weapons is carried out systematically a nd secretly through cryptographic communication networks. In this situa tion, it is not possible to properly respond to current crimes using encr ypted communication without access to these networks. One of the ways to solve this problem is online searches. In Europe, such searches are already being implemented and enforced, and case law is accumulating. The use of various collateral dispositions, the obligation of telecommuni cations providers to cooperate, and the distinction between interception of encrypted communications and online search should be considered in our legislation. However, the case of EncorChat, a cell phone encryptio n network, is currently raising various legal issues in Europe. These le gal issues should also be considered in the context of online searches.
