국문 초록

공식적인 범죄통계에서 정신장애를 가진 범죄자의 특징을 살펴보면, 정신장애를 가진 범죄자는 전체 범죄자에서 차지하는 비율은 매우 낮으나, 정신장애 범죄자는 지속해서 증가추세에 있다. 수사단계에서 검거된 정신장애 범죄자가 공판단계에서 심신장애인으로 판단되어 형이 감면되는 수는 매우 적다. 반면, 정신장애 범죄자의 전과 및재범 비율이 전체 범죄자보다 높을 뿐 아니라 증가하고 있다는 것이다. 이러한 통계에서 알 수 있는 것은 정신장애를 가진 대다수 범죄자는 정신장애가 범행에 영향을 미쳤으나 심신장애에 포섭되지 못한 채 일반적인 형사사법 절차 내에 존재한다는 것이다. 또한 정신장애 범죄자의 재범과 전과 비율의 증가는 그들의 반복적범행에 대한 처벌중심의 현행 형사법적 대응이 한계에 직면했다고 할 수 있다. 심신장애 판단은 정신장애의 진단명이 아니라 정신 증상 등이 범행에 미친 영향의메커니즘을 파악하는 것이다. 또한 심신장애 판단은 형벌 부과와 관련된 범죄 성립 여부 및 책임감경은 물론 양형과 보안처분의 부과와도 밀접하게 관련되어 있다. 따라서 이 연구는 종래 연구 관심 대상에서 소외되었던, 책임능력이 인정된 다수의 정신장애에 대한 법원의 양형 판단을 실증적인 방법을 통해 분석하였다. 대법원 판결서 인터넷 열람제도를 통해 정신장애 인정 여부가 쟁점이 되었으나 책임능력이 인정된 1심 판결문 160건을 분석 대상으로 하였다. 연구의 목적은 책임능력이 인정된 정신장애가 양형에 미치는 영향을 분석하는 것이며, 판결문 분석 결과를 토대로 정책적 개선안을 제시하였다. 대상 정신장애의 일반양형인자로서의 독자적 지위 부여, 정신감정제도의 개선, 특히 책임능력 판단과정의 구조화와 정신감정서 서식의 표준화, 정신장애 범죄자에 대한 정신질환 특징에 따른 다양한 처우 방안 모색을 통한 재범 방지 및건전한 사회복귀 지원 등이 그것이다.

영문 초록

Looking at the characteristics of criminals with mental disorders in official crime statistics, the proportion of criminals with mental disorder s in the total number of criminals is very low, but the number of crimi nals with mental disorders is continuously increasing. There are very fe w cases in which criminals with mental disorders arrested in the invest igation stage are judged as the insanity in the trial stage. On the other hand, the rate of criminal records and recidivism of criminals with ment al disorders is not only higher than that of all criminals, but is also inc reasing. What can be seen from these statistics is that most criminals with m ental disorders exist in the general criminal justice process without bei ng included in insanity, even though mental disorders have influenced th eir crimes. It can be said that the current punishment-oriented criminal law response has faced limitations in the vicious cycle of recidivism or criminal record of mentally disabled criminals. The judgment of legal insanity is not the diagnosis name of mental di sorder, but rather an understanding of the mechanism of the influence o f mental symptoms on the crime. In addition, the judgment of legal insa nity is closely related to whether a crime is established and the reducti on of responsibility, as well as the imposition of sentencing and securit y measures. Therefore, this study analyzed the court's sentencing judgment on me ntal disorders whose responsibility ability was recognized, which was al ienated from the subject of prior research interest, through an empirical method. 160 cases of the first trial's ruling in which mental disability with recognized responsibility was a problem, which were searched thro ugh the online reading system for the Supreme Court ruling, were anal yzed. The purpose of the study is to analyze the effect of mental disor ders with recognized responsibility ability on sentencing, and a policy i mprovement plan was proposed based on the results of the judgment an alysis. These are the granting of independent status as a general sente ncing factor for mental disorder, the improvement of the psychiatric ev aluation system, the prevention of recidivism and the support for sound social return by seeking various treatment methods according to the ch aracteristics of mental illness.
