출소자 재범방지를 위한 생활지원에 관한 연구

국문 초록

최근 5년 동안 우리나라 전체출소자의 재범률은 24.6%로 여전히 높게 나타나고 있다. 재범이란 범죄행위로 인해 처벌 받은 적이 있는 사람이 다시 범죄행위를 저질러 형사처벌을 받는 것을 의미한다. 현행 보호관찰 등에 관한 법률에의하면, 형사처분 또는 보호처분을 받은 법무보호대상자에게 생활지원, 취업지원, 가족지원, 상담지원 등 정신적·물질적 원호를 제공하고 있다. 특히, 생활지원 중숙식제공의 경우 2020년 기준 재범률이 0.2%로 재범방지에 매우 효과적인 것으로 나타났다. 법무보호복지사업을 통해 대상자들에 대한 사회적응을 돕고 재범방지에 큰역할을 하고 있지만 지원사업과 관련하여 예산과 인력 부족 등의 이유로 대상자가 필요로 하는 많은 지원이 이루어지지 않고 있는 실정이다. 이에 따라 법무보호와 관련한 독자적인 법률을 마련하여 법무보호의 업무에 관한 정체성을 강화하고, 업무의 효율성을 높이는 것을 필요하다. 또한 출소자에 대한 생활지원을위한 국고지원의 확대와 숙식제공지원 서비스대상자의 심리상담을 위한 전문인력을 확충하여 이들의 재범방지에 노력해야겠다. 그리고 현재 최대 거주 가능 기간이 2년인 생활관 퇴소자에 대한 주거지원의확대와 보건복지부의 긴급복지지원제도를 법무부로 이관하여 공단에서 수행함으로서 대상자들에게 보다 안정적인 지원을 받을 수 있도록 하여 조기에 사회정착할 수 있도록 하여 재범 가능성이 있는 동안의 재범률을 낮출 수 있을 것으로기대된다. 법무보호와 관련된 정책과 제도의 시행에 있어서 국민들의 공감대 형성을 통해 국가나 지·자·체, 기업, 민간단체 등의 적극적인 협조를 이끌어 내 대상자의 상황과 실정에 맞는 현실적인 법부보호가 이루어졌으면 한다.

영문 초록

Recidivism rate for all prisoners released in our country for the recent 5 years accounts for 24.6%, thereby being still shown highly. A second conviction implies that a person who has ever been punished for a criminal act is criminally punished for committing a crime again. In accordance with the current law on probation, etc., the mental·material supports such as life support, employment support, family support, counseling support, etc. are being provided to the legal protection subjects with criminal or protective disposition. Especially in case of the accommodation provision out of the living support, the recidivism rate based on the year of 2020 amounted to 0.2%, thereby having been indicated to be very effective for the prevention of a repeated crime. The rehabilitation service program leads to playing a great role in deterring a second offense with helping the subjects’ social adaptation. But it is the real situation that many supports needed by subjects are not being made for a reason such as the budget and manpower shortages in relation to a support program. Accordingly, there is a need to step up the identity regarding the work of legal protection and to increase the efficiency of the work through arranging an independent law pertinent to rehabilitation protection. Also, there should be an effort to rule out these ex-prisoners’ recidivism through expanding the state funding aiming at the living support for released prisoners and through strengthening the professional human resources for psychological counseling aiming at the persons eligible for the accommodation support services. Recidivism rate is expected to be likely able to be lowered while there is the possibility of recidivism by extending a residential support for those discharged from a living hall with the maximum two-year residency period at present, by allowing the subjects to be capable of receiving the more stable support through which the public corporation carries out it through transferring the Ministry of Health and Welfare's emergency welfare support system to the Ministry of Justice, and resultingly by making them available for early settling in society. The realistic rehabilitation protection in line with the subjects’ situation and case is desired to be made by drawing active cooperation from the state, local governments, enterprises, private organizations, etc. through forming a bond of sympathy among the people in implementing policies and systems in relation to legal protection.
