출소자의 재범방지를 위한 취업지원에 관한 연구 - 한국법무보호복지공단을 중심으로 -

국문 초록

지난 30년간 우리나라의 범죄율은 2배 이상 증가한 것으로 나타나고 있다. 이러한 범죄의 증가는 사회경제적 차원에서 볼 때, 피해자의 재산과 신체 등에 심각한 해를 끼칠 뿐만 아니라 대중에게 범죄에 대한 두려움을 야기시킴으로써 심리사회적 비용을 발생시킨다. 이에 정계나 학계, 국민들도 재범방지를 위한 대책 방안을 요구하고 있지만, 실질적 인력 및 예산 부족으로 출소자의 사회 복귀 및 재범방지를 위한 추진 사업에 한계가 뒤따르고 있다. 출소자는 사회에 진입하면서 가장 먼저 무관심, 차별, 주변 사람의 냉대와 소외 등을 경험한다고 하였다. 이처럼 출소자를 바라보는 시각이 보수적이거나 낙인적임에도 불구하고 출소자의 재범방지를 위한 제도적 기조는 법무보호복지적 관점에서 논의되어야 할 것이다. 따라서 본 연구에서는 출소자의 재범방지를 위한 대책방안 제안에 연구의 목적을 두었다. 이를 위해 한국법무보호복지공단의 출소자 취업지원 사업현황과 사업수행에 따른 문제점을 분석하였고 이에 대한 대책 방안을 논의하였다. 특히, 공단의 출소자 취업지원 사업에 따른 미흡한 제도 보완을 위한법률 개정의 필요성 등을 제 시하였다. 한편으로는 일본의 법무성, 후생노동성의 출소자 취업지원 사업 실태 및 제도를 고찰하였다. 이러한 연구를 통해출소자의 재범방지를 위한 법무보호복지의 일환인 출소자 취업지원 사업에대해 한층 더 적극적이고 발전적인 논의가 이루어지는데 기여하고자 하였다.

영문 초록

For last 30 years, the crime rate of Korea has been increased more than two times. In the socioeconomic aspect, such increase of crime not only causes serious damage to the victims’ body and properties, but also arouses a fear of crime in the public, which is led to the generation of psychosocial costs. Thus, the political world, academia, and people are demanding the countermeasures for the prevention of repeated conviction. However, due to the shortage of substantial manpower and budget, it is limited to carry out the return to society and prevention of repeated conviction of released prisoners. When the released prisoners enter the society, they first experience indifference, discrimination, inhospitality, and alienation. Like this, the viewpoint on released prisoners is conservative or stigmatizing. And the institutional keynote for the prevention of repeated conviction of released prisoners should be discussed in the perspective of rehabilitation. Therefore, the objective of this study was to suggest the countermeasures for the prevention of repeated conviction of released prisoners. For this, this study analyzed the current status of employment support program for released prisoners by Korea Rehabilitation Agency, and problems with the performance of the program, and then discussed the countermeasures. Especially, this study suggested the necessity of the revision of law to complement such insufficient institutions according to the agency’s employment support program for released prisoners. Meanwhile, this study also considered the actual status and institution of employment support program for released prisoners, by the Ministry of Justice, and the Ministry of Health, Labor, and Welfare of Japan. This study aimed to contribute to more active and developmental discussions about employment support program for released prisoners as a part of rehabilitation for the prevention of repeated conviction of released prisoners.
