고령자의 삶을 위한 임대차 계약에서의 차별금지 방안 연구

국문 초록

초고령사회 진입을 눈앞에 두고 있는 우리나라에서 혼자 사는 노인 가구 비율뿐만 아니라 월세 거주 비율도 꾸준히 증가하고 있다. 그런데 최근 심각한 사회문제 중 하나는 고령이라는 이유로 임대차 계약을 체결할 때 거절당하는 사례가 발생하고 있다는 점이다. 임대차 계약에 있어 누구와 계약을 맺을 것인지에 관한 상대방 선택의 자유는 계약자유 원칙의 핵심 내용 중 하나이므로 마땅히 보장받아야 한다. 그런데 고령이라는 이유로 상대방으로부터 계약 체결을 거부당하고 결국 존립의 기본이 되는 삶의 터전을 잃고, 나쁜 환경으로 내몰리는 것도 사회적으로 결코 바람직한 모습은 아니다. 우리나라에서는 국가인권위원회법이 폭넓게 차별금지를 규정하고 있지만 법적 구속력이 없어 실효성이 미흡하다. 이에 반해 장애인 차별, 고령자 고용 등 개별법 차원에서 규율이 이루어지는 분야에서는 합리적이지 않은 차별에 대한 권리구제에 있어 보다 효과적이다. 이 때문에 사법(私法)적 구제 내용을 포함한 내용을 담은 차별금지에 관한 일반법 제정이 요청되는 것이다. 그러한 법이 없다면 계약의 무효나 불법행위책임을 통한 해결을 도모할 수밖에 없는데, 계약자유 원칙과의 관계에서 이러한 차별에 대한 위법성을 인정하기가 쉽지 않기 때문이다. 독일에서는 ‘일반평등대우법’(Allgemeines Gleichbehandlungsgesetz, AGG)을 제정하여 이 문제를 해결해 왔다. 독일 내에서도 이러한 일반법 제정에 대해 제정 당시에 많은 비판이 있었지만, 이 법은 지금까지 차별금지와 관련하여 공동체 구성원의 의식 전환에 기여하고, 민법의 일반조항으로의 한계를 극복한다는 점에서 큰 역할을 해 왔다. 이 연구에서는 ① 일반평등대우법의 적용대상이 되는 임대차 계약의 범위, ② 임대차 계약에서 차별이 정당화되는 요건, ③ 불합리한 차별이 있는 경우 인정되어야 할 법적 효과 등 세 가지 사항에 대해 비교법적으로 검토해보았다.

영문 초록

As Korea is facing super-aged society, the rate of the elderly living alone is increasing along with their rate of living by monthly rent. Recent social problem is that some people get rejected to make a lease contract only because of their old age. Regarding lease contract, freedom of choice in selecting whom to make contract with must be guaranteed, for it is one of the core contents of liberty of contract. It is not socially desirable for the elderly to get rejected for the conclusion of contract and lose their base of existence, which could drive them into a noxious environment. Korea regulates discrimination by National Human Rights Commission Act; however, there is no legal binding power and therefore insufficient of actual effect. Meanwhile, relieving rights against unreasonable discrimination is more efficient in areas where regulations are enforced at the level of individual laws such as discrimination against the disabled and employment of the elderly. This is why the enactment of general law regarding private law remedies in antidiscrimination is being requested. Without a general law about antidiscrimination, it is inevitable to seek resolution through invalidation of contracts or liability for illegal activities; however, it is not easy to admit the illegality of such discrimination in relation to the freedom of contract. Germany has solved this problem by legislating ‘General Act on Equal Treatment’ (Allegemeines Gleichbehandlungsgesetz, AGG). Although there was a lot of criticism at the time of enactment of this general law, this law has played a major role in contributing to the community members’ conversion of awareness and overcoming the limitations of general provisions of civil law. This study comparatively reviewed a) scope of lease contracts subject to the General Equal Treatment Act, b) requirements for the justification of discrimination in a lease contract, and c) legal effect to be recognized in the event of unreasonable discrimination.
