생명정치 하에서 법의 위상과 역할

국문 초록

언제부턴가 법률안 앞에 피해자의 이름이 붙는다. 이러한 ‘네이밍 법안’들은 ‘법이 된 죽음(들)’을 기린다. 이 글에서 다루고자 하는 ｢중대재해 처벌 등에 관한 법률(이하 ‘중대재해법’이라 한다)｣도 소위 ‘故 김용균법’이라는 이름으로 불렸던 ‘위령비로서의 법’들 중 하나이다. 생명정치는 서구 근대성을 극복하려는 탈근대의 철학적 맥락 속에서 등장한다. 즉 인간에 대한 근대적 이해(휴머니즘과 이성, 합리성 등)에 대한 극복과 자본주의 및 과학기술주의의 과잉 속에서 위태로워져 가는 인간의 생명과 삶에 주목한 것이 바로 ‘생명정치(적 관점)’이다. 그리고 법은 푸코, 아감벤, 하트/네그리의 생명정치담론에 있어서 일정부분 관여하는 사회적 조건이라는 점에서 생명정치와 관련성을 맺는다. 그 법률명이 말해주듯 ｢중대재해처벌법｣은 재해책임자의 처벌을 위해 특별히 제정된 법이다. 그리고 그 처벌의 정당성을 ‘중대재해의 예방’ 및 ‘생명과 신체의 보호’에서 구한다. 바로 이 지점, 즉 ‘생명과 신체의 보호’를 처벌의 정당화 근거로 전면에 내세우는 그 순간부터 처벌을 위한 법은 ‘생명정치’와 연결되고, 그 과정에 ‘생명권력’이 개입한다. ｢중대재해처벌법｣은 ‘종사자 및 시민’으로 보호대상을 확장함으로써 ‘살게 만들어 주는’ 생명권력의 모습을 보여주면서도, [원칙-예외]의 규범틀을 통해서 적용대상과 범위를 축소/제한하여 예외상태 또는 사각지대를 창출해내고 그 속에서 ‘죽게 내버려두는’ 생명권력의 어두운 모습까지 함께 가지고 있다. 그러나 이전에는 불가능했던 경영책임자와 법인의 처벌을 가능케 하는 ｢중대재해처벌법｣이 제정되었다는 그 사실 자체가 이미 생명권력에 대한 ‘다중’의 저항이 시작되었음을 말해주는 것일지도 모른다. 생각건대 법시행 1년이 지난 현 시점은 아직까지 삶과 죽음을 가르는 법의 경계가 명확하게 그어지지 않은 시점이라 평가할 수 있다. 따라서 다중의 지속적인 관심과 문제 제기를 통해 조금 더 삶의 영역을 넓히는 방향으로, ‘조에’나 ‘호모 사케르’로서가 아니라 ‘비오스’로서 ‘살게 만들어 주는’ 방향으로 법의 경계선을 다시 그을 수 있는 기회가 바로 지금이 아닌가 한다.

영문 초록

At some point, the victim’s name comes before the bill. These ‘naming bills’ honor ‘deaths that became law’. The ｢SERIOUS ACCIDENTS PUNISHMENT ACT｣ to be covered in this article is one of the “Acts as a Monument” which was called the “Late Kim Yong-kyun Act.” Bio-politics emerges in the philosophical context of postmodernity to overcome Western modernity. In other words, it is the “Bio-politics” that focuses on overcoming modern understanding of humans (humanism, reason, rationality, etc.) and human life and life that are at stake in the excess of capitalism and science and technology. And the law is related to Bio-politics in that it is a social condition that is partially involved in the discussion of life politics of Foucault, Agamben, and Hart/Negri. As the name of the law says, the Serious Disaster Punishment Act is a law specially enacted for the punishment of disaster managers. And the legitimacy of the punishment is sought from “prevention of serious disasters” and “protection of life and body.” From this point, the moment when “protection of life and body” is put to the forefront as the justification for punishment, the law for punishment is linked to “Bio-politics” and “Bio-power” intervenes in the process. The ｢SERIOUS ACCIDENTS PUNISHMENT ACT｣ shows the appearance of “living” Bio-power by expanding the scope of protection to “workers and citizens,” but also creates exceptions or blind spots by reducing/limiting the scope and scope of application through the norm framework of “principle-exception.” However, the fact that the ｢SERIOUS ACCIDENTS PUNISHMENT ACT｣ was enacted to enable punishment of managers and corporations, which was previously impossible, may indicate that “multiple” resistance to life power has already begun. I think that the current time, one year after the enforcement of the law, is a time when the boundaries between life and death have not yet been clearly drawn. Therefore, now is the time to redraw the boundaries of the law in the direction of expanding the realm of life a little more through multiple continuous attention and raising questions, not as “Joe” or “Homo Soccer,” but as “Bios.”
