학술지원사업의 연구과제 관리와 연구자의 학문 활동의 자유

국문 초록

연구자는 연구 분야가 어떠한지를 불문하고 헌법 상 보장되는 학문의 자유를 지니고 있다. 학문의 자유를 통하여 연구자가 창출한 연구결과는 궁극적으로 사회적 이익 내지 경제적 이익으로 창출되기 때문에 각국 정부와 대학은 연구자에게 연구비를 지급하는 소위 ‘학술지원사업’을 대대적으로 진행하고 있다. 우리나라 역시 교육부 등을 주축으로 한국연구재단을 주무기관으로 정하여 연구자 개인은 물론 대학이나 연구소 등 기관에 대해서 다양한 학술지원사업을 도모하고 있다. 그런데 한국연구재단의 학술지원사업이 과연 연구자의 학술･연구개발 활동을 효율적이고 공정하게 지원하고 그 사업을 통한 연구결과의 관리나 연구자에 대한 규제가 적절한지 및 연구자의 학문 활동을 침해하는 것은 아닌지에 대하여 의문이 드는 대법원 판결이 최근 선고된 바 있다. 왜냐하면 한국연구재단의 과도한 학술･연구개발 활동의 관리나 규제는 연구자의 학문의 자유를 침해할 뿐만 아니라 정부가 지향하는 연구에 대한 규제를 철폐하는 기조에 역행하는 것이기 때문이다. 본고에서는 한국연구재단의 인문사회분야 학술지원사업과 관련하여 최종 연구결과물 제출･관리에 대한 규제에 있어서, 현행법령의 근거가 무엇인지, 그것이 연구자가 지니는 학문의 자유에 어떠한 영향을 미치는지를 살펴본다. 그리고 실제 사안에서 법원이 연구자의 학문 활동의 자유과 학술지원사업의 규제와의 관계를 어떻게 파악하는지를 점검해보고자 한다.

영문 초록

Researchers have academic freedom guaranteed by the Constitution, regardless of the field of research. Because the research results created by researchers through academic freedom are ultimately created as social or economic benefits, governments and universities in each country are conducting so-called 'academic support projects' that provide research funds to researchers on a large scale. In South Korea, the Ministry of Education has designated the National Research Foundation of Korea as the leading institution to promote various academic support projects not only for individual researchers but also for institutions such as universities and research institutes. However, whether the research support project of the National Research Foundation of Korea effectively and fairly supports the academic and R&D activities of researchers, whether the management of research results through the project, and the regulation of researchers are appropriate, and whether it infringes on the academic activities of researchers. Supreme Court decision has recently been pronounced that the excessive management of academic and R&D activities by the National Research Foundation of Korea infringes on researchers' academic freedom and goes against the stance of abolishing regulations on research aimed at by the government. In this paper, we examine what the basis of the current laws and regulations are for the regulation of the submission and management of final research results in relation to the National Research Foundation of Korea's academic support project in the field of humanities and social sciences, and how it affects the academic freedom of researchers. In addition, I will examine how the court understands the relationship between the freedom of academic activities of researchers and the regulation of academic support projects in real cases.
