국문 초록

자율주행차의 보급은 교통사고를 획기적으로 감소시킨다거나 자율 주행 중 운전 이외의 업무를 수행할 수 있게 하는 등 우리사회에 큰 이익을 가져다 줄 것으로 기대된다. 그렇다고 하더라도 자율주행차의 상용화를 위해서는 법적 측면뿐만 아니라 심리적·윤리적·경제적 측면 등에서 해결되어야 할 중요한 문제를 던지고 있다. 특히 레벨3의 자율주행기술의 이용이 가능하게 된 현재, 향후 레벨4의 자율주행에 대한 적법화의 요구도 높아질 것으로 보인다. 그 중에서도 자율주행차에 있어서 도덕적 의사결정을 어떻게 구현할 것인가는 여전히 광범위하게 논의되고 있다. 이러한 관점에서 본 논문은 L4 및 운전권한 인수 이전의 L3에서 공통된 문제라고 볼 수 있는 이른바 ‘딜레마 상황’에 대한 법제도적 대응방법을 검토하였다. 자율주행차가 교통사고를 발생시키지 않고 안전하게 이용되기 위해서는 자율주행기술을 더욱 더 발전시키는 것이 요구되지만 장래에도 자율주행에 따른 교통사고의 발생을 완전히 배제하기는 어려울 것이다. 특히 딜레마 상황과 같은 윤리적 충돌상황을 염두에 둔다면 자율주행자동차의 상용화는 불가능하게 될 수도 있다. 그러나 윤리적 딜레마는 인간이 운전하는 경우에도 발생하고 있으며, 이러한 점을 감안한다면 사고유형에 따른 확률상 안전성과 시뮬레이션을 통한 사회적 공감대를 형성할 필요가 있다. 또한 사고가 발생한 경우에도 그 피해를 최소한으로 억제하는 대책이 필요하다. 그러한 대책은 대부분 기술공학적 발전으로 구현될 수도 있지만 법제도를 통해 사고발생에 대한 책임의 내용과 그 귀속을 명확히 하고, 자율주행차의 이용자에게 그 이용에 따라 발생할 수 있는 불이익을 고지하면서 자율주행차의 이용을 도모하는 것이다. 본 논문은 이를 위한 하나의 관점으로서 사고발생이 불가피한 장면, 이른바 ‘딜레마 상황’에 대한 법제도적 대처방법과 관련하여 이론적 관점, 수적 처리의 관점, 사람들의 윤리관을 파악하는 방식 등을 통해 검토하였다.

영문 초록

The spread of autonomous vehicles is expected to bring great benefits to our society, such as dramatically reducing traffic accidents or enabling tasks other than driving while driving autonomously. Even so, for the commercialization of autonomous vehicles, important issues need to be solved in terms of psychological, ethical, and economic aspects as well as legal aspects. In particular, with the availability of level 3 autonomous driving technology, the demand for legalization of level 4 autonomous driving is expected to increase in the future. Among them, how to implement moral decision-making in autonomous vehicles is still widely discussed. From this point of view, this paper reviewed the legal and institutional response to the so-called ‘dilemma situation’, which can be seen as a common problem in L4 and L3 prior to the acquisition of driving rights. In order for autonomous vehicles to be used safely without causing traffic accidents, further development of autonomous technology is required, but it will be difficult to completely rule out the occurrence of traffic accidents caused by autonomous driving in the future. Ethical dilemmas can arise at any time, not only in autonomous driving but also in human driving. Therefore, if a dilemma situation can occur and a social consensus is formed through probability safety and simulation, it is necessary to take measures to minimize the damage in case of an accident in the dilemma situation. Most of such countermeasures are expected to be implemented through technological engineering, but the occurrence rate of such accidents will not be zero(0%) in the future. In the end, it is to promote the use of self-driving cars by clarifying the details of responsibility for accidents and their attribution through the legal system, and notifying the users of autonomous vehicles of the disadvantages that may occur according to their use. Therefore, this paper, as one of these countermeasures, we have in mind the so-called 'dilemma situation' as a common problem for L3 before L4 and TO, was reviewed that when faced with a dilemma situation, the decision subject and criteria for making an action choice, and the scope of application of the emergency evacuation regulations under the Criminal Act, and the application of criminal negligence and statistical analysis of autonomous vehicle accident cases based on that understanding Ethics of people. Therefore, in this paper, as one of these countermeasures, we keep in mind the so-called ‘dilemma situation’ as a problem common to L4 and L3 prior to TO, and as a countermeasure, it was reviewed when faced with a dilemma situation, the subject of decision and the criterion of decision and the application of negligence in the criminal law to autonomous vehicle accident cases and people's ethics through statistical analysis.
