탈북자의 인권침해실태와 보호방안

국문 초록

본 논문은 최근 국내외적으로 큰 관심을 불러일으키고 있는 탈북자의 인권침해 실태와 보호방안을 살펴보기 위한 것이다. 재외 탈북자는 중국, 러시아, 몽골, 구소련, 동남아 지역국가 등에 분포되어 있지만, 중국에 거주하는 재외 탈북자가 대다수이다. 재외 탈북자의 체류유형을 보면 여성이 탈북자 4분의 3이상을 차지하고 있는데 이들 여성 중 절반 정도가 중국남성과 동거형태로 생활하고 있고 인신매매조직에 이끌리어 오게 된 여성도 적지 않으며 남성들의 경우는 노동력이 귀한 오지지역의 벌목공 또는 탄광광부로 거래되는 사례가 발견되고 있다. 재외 탈북자들은 불법체류자 또는 인신매매대상으로서 성적 착취, 매춘, 강제노동 및 서비스, 노예상태에 준하는 행태 등으로 인권유린을 당하지만, 송환시에는 노동단련형, 노동교화형, 무기노동교화형, 사형(주로 인신매매범, 절도범의 경우) 또는 재산몰수형 등의 처벌을 받게 됨으로써 절박한 환경에서 살아가고 있다. 탈북자의 처벌은 1995년 이전에는 탈북자를 정치범으로 간주하여 정치범수용소에서 특별 관리하고 가족들도 통제구역으로 강제이주조치 취하다가, 1995~1998년 기간에는 9·27 구호소(꽃제비 수용소)에서 일정기간 수용 후 석방하는 등 탈북자에 대한 처벌이 완화되었으며, 1998년 이후 중국 등으로 국경이동 북한주민의 급격한 증가와 북한의 경제난으로 사회질서가 이완되면서 탈북자 및 국경이동 북한주민에 대한 처벌이 초기에 비해서는 현저히 약화되었나 본질적으로 개선되지 않고 있는 것이 현실이다. 아무리 불법이주자(undocumented migrant)라 할지라도 생명권, 노예 및 강제노동금지, 고문 및 비인도적인 처우금지, 사생활 보호권, 이동의 자유, 사상 및 종교의 자유, 표현의 자유 등 기본적인 인권을 침해당하지 않을 권리는 가지고 있는 것이다. 탈북자문제 등 인권문제는 누구든지 문제를 제기하지 않으면 개선되기 어려운 사안이다. 한국정부는 중국 등에 있는 탈북자가 난민협약 당사자가 되도록 노력하고 국내입국탈북자가 성공적으로 적응할 수 있도록 다양한 프로그램을 개발·적용하는 한편, 근본적으로는 북한의 인권상황을 개선하여 삶의 질 향상을 통해 탈북자의 발생을 억제하도록 하는데도 최선의 노력을 다해야 할 것이다. 동독주민의 자유와 인권신장문제에 일관되게 역점을 두어온 것이 동독의 민주화를 부추겼고, 이것이 결국 통일로 이어지게 한 독일의 사례를 타산지석(他山之石)의 큰 교훈으로 삼아야 할 것이다.

영문 초록

The research objective of this paper is to analyze the current situations of human rights violations and protective plans for North Korean refugees. The violation of North Korea's human rights is not the problem of a specific state but worldwide problem. Recently the number of refugees from North Korea has grown rapidly. They have suffered from the violations of human rights during staying in China or other countries in the process of escaping from North Korea. In China, the irregular status of undocumented North Korean women contributes to their vulnerability to sexual exploitation, including trafficking into forced marriage, the sexual industry, as well as voluntary and quasi-voluntary arranged marriages. Of course, numerous refugees have stayed very long in those areas. They are placed in adversity and very bad surroundings. Tens of thousands of irregular North Koreans living in China continue to be vulnerable to exploitation and abuse. They have no protection from the authorities in either China or North Korea, and there is a little recognition of their plight from the international community. Leaving North Korea without permission is a criminal offence that can carry the death penalty, so deportation has very serious consequences. Those who come to the attention of the Chinese authorities are forcibly repatriated to North Korea where they will detained and may be subjected to forced labour and torture. There are countless testimonies beatings, tortures, deregarding treatment, and even forced abortions and infanticide from those who have escaped. In North Korea, there are severe deprivations of human dignity and freedom. The human rights' problem of refugees from North Korea is originated from very miserable conditions of the fundamental human rights in North Korea. The success of adaptation of refugees in South Korea means to be able to become the preliminary South-North integration model. Korean government should establish and carry out the multilateral plans for human rights protections of the refugees from North Korea. Korean government should join hands with various international organizations and persuade Chinese government to be the party to an agreement for North Korean refugees, to solve the problem of them. And especially, Korean government should begin to bargain with North Korean government under the principle of reciprocity to develop the infringement of fundamental human rights in North Korea.
