국문 초록

2020년 발생한 코로나19팬데믹은 학생들의 학교생활에 큰 영향을 미쳤다. 학생들은 집합금지 및 거리 두기 정책으로 인해 원격 수업과 대면 수업을 병행하게 됐고, 학습의 장이 사이버 공간과 현실 공간으로 확정되어 유기적으로 연결되는 것을 직접 경험하게 됐다. 이러한 변화가 학생 상호 간의 관계 형성과 교류 방식에 영향을 미치고, 긍정적인 부분 외에 학교폭력과 같은 부정적인 부분에도 영향을 미칠 것임은 충분히 예상할 수 있다. 포스트 코로나 시대를 준비하는 지금, 변화된 학교생활에서 발생할 수 있는 학교폭력을 예견하고 관련정책을 마련하는 것이 필요하다. 현재 학교폭력과 관련된 대표적인 법률은 「학교폭력예방 및 대책에 관한 법률 (약칭 :학교폭력예방법)」이다. 본 연구는 학교폭력예방법을 중심으로 코로나19팬데믹 전후인 2019년부터 2022년까지의 학교폭력 실태조사를 살펴보고, 현행 「학교폭력예방법」의 내용과 문제점을 살펴보고, 「학교폭력예방법」의 개선방안을 제안하고자 한다.

영문 초록

The COVID-19 Pandemic that occurred in 2020 had a significant influence on the school lives of students. Due to the anti-gathering COVID rules and social distancing policy, students were allowed to take remote non-face-to-face classes and face-to-face classes at the same time. This led to the expansion of the learning space and the organic connection between the cyberspace and real-life classes/schools. It is easy to predict that such changes will have a huge influence on how students interact with each other and form new relationships. Meanwhile, it will also have a significant influence on the negative aspects, including school violence and bullying. Now that we are preparing for the post-COVID-19 era, it is necessary for us to predict the new types and trends of school violence/bullying that may occur in the changing school/educational environment and prepare new policies to cope with such issues. Such changes in the learning environment are likely to have a great influence on inter-student interaction and communication. Naturally, it will also affect the various conflicts that may occur between students, especially school violence and bullying. Currently, one of the most well-known law related to school violence is the 「Act on the Prevention of and Countermeasures Against Violence in Schools」, also known as the ‘School Violence Prevention Act’. The main purpose of this study is to examine the actual trend of school violence from the year 2019 to 2022 (pre-COVID to post-COVID), examine the articles and limitations of the ‘School Violence Prevention Act’, and propose new ways to improve the ‘School Violence Prevention Act’.
