국문 초록

본 연구는 우리나라 지방자치제도가 대한민국 정부수립 이후 많은 발전을 거듭하였으나 아직도 해결해야 할 과제들이 많이 남아있다는 문제의식에서 출발하였다. 연구의 목적은 지방정부의 정치․행정을 효과적으로 수행하기 위한 지방의회의 발전과제를 밝히는 것이며 연구방법은 지방자치법을 비롯하 여 지방자치 관련 법률의 제․개정사항을 분석하고 이와 관련된 선행연구를 토대로 주요 쟁점사항을 도출하여 지방의회 발전과제를 모색하는 문헌조사를 위주로 하였다. 지방자치 관련 선행연구들은 지방정부 기관구성 형태, 지방의회 사무기구 인사권 독립, 주민직접참정제도의 도입, 지방정부 자치입법권 확립, 지방의원 보좌관제 필요성 등에 관한 논의가 많았다. 이러한 주요 쟁점사항들을 고찰하여 지방의회 발전과제로서 현행 기관대립 형 외 다양한 지방정부 기관구성, 기초의원 정당공천제 폐지, 법률과 법규명령 만을 조례의 우위로 인정하는 자주적인 조례제정권 확보, 법률유보조항 삭제 를 통한 지방정부 조례 실효성 강화, 지방자치를 약화시키는 기관위임사무제 도 폐지, 지방의회의원 보좌관제 도입, 지방의원 소개 없는 주민동의 청원제도 도입 등을 제시하였다.

영문 초록

This study started with a critical mind that although the local autonomy system in Korea has developed a lot since the establishment of the Korean government, there are still many tasks to be solved. The purpose of the study is to identify the development tasks of the local council to effectively carry out the politics and administration of the local government. Literature research was mainly conducted. By reviewing previous studies related to local autonomy, this study presents development tasks for local councils. These include the formation of various local government agencies other than the current institutional confrontation type, the abolition of the party nomination system for local council members, the securing of the right to independently enact ordinances that recognizes only laws and statutory orders as ordinances, strengthening the effectiveness of local government ordinances by deleting legal reservations, and local autonomy. These also include the abolition of the institutional delegation system that weakens the government, the introduction of an aide system for local council members, and the introduction of a resident consent petition system without introduction of local council members.
