지역산업 진흥을 위한 자치입법권의 강화방안

국문 초록

지역의 인구감소현상 심화와, 지역산업의 인프라와 일자리·인력·자본의 부족으로 지역불균형이 심화되어 가고 있을 뿐만 아니라 지방의 기업과 공장이 수도권이나 해외로 이전하여 지역자립과 지역경제발전을 훼손하고 지역소멸의 우려를 가속화하고 있는 실정이다. 이에 윤석열정부는 ‘대한민국 어디서나 살기 좋은 지방시대’를 국정목표로 설정하고, ‘수도권 쏠림-지방소멸’의 악순환을 끊고, 지속가능한 지역산업진흥과 지역균형발전을 국정과제로 선정하고 있다. 지역산업을 진흥육성하여 지역의 특성과 산업여건에 맞는 지역경제발전을 하기 위해서는 지방자치단체의 자율성을 강화하도록 하는 자치입법의 체계의 개선이 요구되고 있다. 헌법 제123조에서 지역균형발전과 농업·어업 및 중소기업 보호육성을 하도록 하여 지역산업을 진흥하도록 하고, 헌법제117조제1항에서 법령을 위반하지 않는 범위 내에서 지역산업진흥에 관한 자치입법을 하도록 하고 있다. 국가균형발전특별법에서는 지역주도의 지역산업진흥시책을 마련하고 지방자치단체가 지역특화산업과 지역산업육성 및 활성화시책을 추진하고, 주민생활기반의 확충, 지역균형뉴딜, 인구감소지역의 지역특화산업을 위하여 행정적, 재정적 지원을 할 수 있도록 하고 있다. 지방자치법 제13조제2항에서는 지역산업의 육성지원사무, 지역특화산업개발과 육성지원사무, 중소기업육성사무를 자치사무로 명시적으로 열거하고 있으므로 지방자치단체가 자치입법권에 의하여 지역산업진흥에 관한 조례와 규칙을 제정하여야 함에도 불구하고, 지역산업진흥 관련 법령에서 지방자치단체의 자율적인 자치입법권을 행사할 수 없도록 사무처리절차와 기준 등을 세부적인 사항을 규율하여 지역특성과 여건에 따른 지역산업진흥이 저해되고 있다. 따라서 지역산업진흥에 관한 입법체계를 분석 검토하여 지역특성과 여건에 따른 자율적인 자치입법권의 강화방안을 모색하고, 지역특화산업진흥을 위하여 국가 법령에서의 네거티브 입법체계를 개선하여 선허용 후규제 원칙에 의한 패러다임 전환문제와, 지역산업진흥법령에서 지역산업진흥에 관한 세부적인 사항을 규율할 것이 아니라 조례입법으로 전환문제를 검토하여 그 개선방안을 제시한다. 또한 지방자치단체가 지역산업진흥에 관한 자치조례와 위임조례를 적극적으로 제정할 뿐만 아니라 지역산업진흥기본조례제정과 규제특례의 조례 도입확대, 지역기업파트너십제도화를 통하여 지역산업이 실질적으로 진흥되고 지속가능한 발전이 이루어지는 방안을 강구한다.

영문 초록

Not only is regional imbalance deepening due to the declining population of the region and the lack of infrastructure, jobs, manpower, and capital in the region, but also the relocation of local companies and factories to the metropolitan area or overseas, undermining regional self-reliance and regional economic development. It is a situation that is accelerating the concern of local extinction. In response, the Yoon Seok-yeol administration has set the “regional era where it is good to live anywhere in Korea” as a national goal, breaks the vicious cycle of “concentration in the metropolitan area and disappears in the local area,” and is selecting sustainable regional industry promotion and balanced regional development as state affairs tasks. In order to promote and nurture local industries and develop the local economy that meets the characteristics and industrial conditions of the region, it is required to improve the system of self-governing legislation to strengthen the autonomy of local governments. Article 123 of the Constitution stipulates balanced regional development, protection and fostering of agriculture, fisheries, and small and medium-sized enterprises to promote regional industries, and Article 117 (1) of the Constitution stipulates self-governing legislation on regional industry promotion within the scope of not violating laws and regulations. have. The Special Act on Balanced National Development prepares regional industry promotion policies led by local governments, promotes policies for fostering and revitalizing regional specialized industries and local industries, expands residents' living base, balances regional New Deal, and promotes regional specialized industries in declining population areas. To provide administrative and financial support. Article 13 (2) of the Local Autonomy Act explicitly enumerates the affairs of fostering local industries, developing and fostering support for regionally specialized industries, and fostering small and medium-sized enterprises as self-governing affairs, so that local governments can Despite the need to enact ordinances and rules, regional industry promotion according to regional characteristics and conditions by regulating the details of office handling procedures and standards so that local governments cannot exercise their autonomous legislative power in local industry promotion-related laws and regulations this is being hindered. Therefore, by analyzing and reviewing the legislative system for regional industry promotion, seeking ways to strengthen autonomous legislative power according to regional characteristics and conditions, and improving the negative legislative system in national laws and regulations to promote regionally specialized industries Instead of regulating the paradigm shift problem caused by the local industry promotion ordinance and the detailed matters related to regional industry promotion in the local industry promotion ordinance, the ordinance legislation reviews the conversion problem and suggests an improvement plan. In addition, local governments should actively enact autonomous ordinances and delegation ordinances related to regional industry promotion. Furthermore, through the enactment of basic ordinances for regional industry promotion, the expansion of the introduction of special ordinances for regulation, and the institutionalization of regional business partnerships, measures are sought to substantially promote regional industries and achieve sustainable development.
