국문 초록

감염병의 확산은 여러 요인들이 있을 수 있으나 기업들의 이윤극대화를 목표로 하는, 제어되지 않는 자본주의적 생산분배 시스템과 결합한 인간의 끊임없는 탐욕과 자연환경 및 자원의 착취, 공장식 축산 등에서 비롯한 환경오염, 생태위기와 밀접한 관련이 있다. 현재와 같은 시스템을 제어하지 않는 한 파국으로 향해 가는 기차를 멈추기 어렵다. 현대 국가들에서 국가는 전체 국민들의 보편적 이익을 구현한다는 점에서 정당성을 얻는다. 코로나 팬데믹의 공중보건위기에서 정부가 취하여야 할 태도와 역할은, 국민의 생명과 안전이라는 보편적 이익을 추구해야 한다는 명분과 국가의 정당성으로부터 뿐만 아니라 이미 헌법 전문의 안전확보, 인간의 존엄, 생명권과 신체의 자유, 재해로부터 국민보호 등에 관한 헌법 규정들과 공공보건의료법이나 감염병예방법 등 법률적 근거로부터 충분히 도출될 수 있다. 정부는 재난상황을 사전에 예방하려는 구조적이고 체계적인 노력을 하여야할 뿐만 아니라 이미 발생한 재난상황에 대하여 국민의 생명과 신체에 대한 피해가 최소화되도록 대응하여야 한다. 긴급상황에서 이를 위한 각종 매뉴얼과 위기대응 시나리오를 마련하고 적극 대처하여야 한다. 그러나 코로나 팬데믹 사태에서 각국 정부가 취한 다양한 태도들에서 보듯이, 정부의 역할에만 기댈 수만은 없다. 개개의 인간 및 시민사회의 역할이 매우 중요하다. 시민들스스로 인간의 주체성에 대한 각성을 하여야 한다. 다양한 이유로 구조의 노예로 살아가는 인간이 스스로의 주체성을 자각하고 연대하고 인간성을 고양하여 구조를 혁신하고 민주주의를 심화시키기 위한 끊임없는 노력을 하여야 한다.

영문 초록

The spread of infectious diseases may have several factors, but human endless greed combined with an uncontrolled capitalist production and distribution system aimed at maximizing profits of companies, exploitation of the natural environment and resources, environmental pollution caused by factory farming, It is closely related to the ecological crisis. Unless we control the current system, it is difficult to stop the train headed for catastrophe. In modern states, the state gains legitimacy in that it embodies the universal interests of the people. The attitude and role that the government should take in the public health crisis of the COVID-19 pandemic can be sufficiently derived not only from the justification of pursuing the universal interest of the people’s life and safety and from the legitimacy of the state, but also from constitutional and legal grounds. The government should not only make structural and systematic efforts to prevent disaster situations in advance, but also respond to disaster situations that have already occurred so that damage to the lives and bodies of citizens is minimized. In an emergency, various manuals and crisis response scenarios must be prepared and actively dealt with. However, as we can see from the various attitudes taken by governments in the face of the COVID-19 pandemic, we cannot rely solely on the role of the government. The role of individual people and civil society is very important. Citizens themselves must awaken to the subjectivity of human beings. Human beings, who live as slaves to structures for various reasons, must realize their own identity, solidarity, and enhance humanity to innovate structures and make ceaseless efforts to deepen democracy.
