국문 초록

헌법상 보장되고 있는 사유재산권의 보호와 공정·공평한 부의 재분배를 위해서 어느 범위까지 사유 재산권의 제한을 둘 수 있는지에 대한 논쟁들이 지속되며 토지수용시 보상의 문제또한 꾸준히 논의되고 있다. 우리 헌법에서는 공공필요를 위하여 국민의 재산권에 대하여 침해를 하는 경우에는 법률로써 정하되 정당한 보상을 지급하도록 규정하고 있다. 헌법은 정당한 보상의 원칙을 선언하고 있다. 오늘날에는 국민의 경제생활이 고밀도화 됨에 따라 공익사업으로 인하여 침해되는재산권도 토지소유권에 한정되지 아니하고 다양화되고 있고, 또한 재산권상실에 부대되는 경제적 손실도 다양화되고 있다. 따라서 그 손실보상의 내용도 재산권 보상뿐만 아니라 그 생활을 유지하기 위한 생활보상, 사업손실보상, 정신적 보상 등 그 보상내용이 다양화되고 있다. 헌법상 보장된 사유재산권의 보호와 수용에 의한 보상은 정당한 보상이 되어야 한다. 수용에 따른 손실보상의 갈등문제 있어서 가장 핵심적인 문제인 공시지가에 의한 보상 문제를더 적극적으로 해석하여 실거래가 수준의 보상이 이루어져 토지수용시 토지 소유자의 억울함에도 귀를 기울이는 제도들이 필요 할 것이다.

영문 초록

Controversy continues over the extent to which private property rights can be restricted for the protection of private property rights guaranteed by the constitution and the redistribution of fair and fair wealth, and the issue of compensation in the expropriation of land continues to be discussed. In the case of infringement on the property rights of citizens for public necessity, the Korean Constitution stipulates that a legitimate compensation is paid, though it is prescribed by law. The constitution declares the principle of just compensation. Today, as the economic life of the people becomes denser, property rights infringed by public services are not limited to land ownership, but are diversified, and economic losses incurred by loss of property rights are also diversifying. Therefore, the contents of compensation for losses are diversified, such as compensation for life, compensation for business losses, and mental compensation for maintaining the life as well as property rights compensation. Compensation for the protection and expropriation of private property rights guaranteed by the Constitution should be just compensation. It is necessary to more actively interpret the issue of compensation by the publicly announced land price, which is the most important issue in the conflict of compensation for losses due to acceptance, to provide compensation at the level of the actual transaction price, and to listen to the resentment of the landowner during land expropriation.
