존·비속 범죄에서 가해자 - 피해자 관계가 범죄의 심각성 인식과 법적 판단에 미치는 영향

국문 초록

본 연구에서는 존속과 비속이라는 가해자-피해자 관계가 존ㆍ비속 범죄 사건의인식과 처벌판단에 미치는 영향을 알아보고, 판단에 있어서 연구 참가자의 성별 및연령대에 따른 차이가 발생하는지 조사하고자 하였다. 이를 위해 한국 국적을 가진20대에서 50대 사이의 성인 남녀 336명을 대상으로 존ㆍ비속 범죄 사건에 대한 판단을 내리도록 하였다. 연구 결과, 존속 범죄보다 비속 범죄의 심각성을 더 높게 지각하였고, 피해자가 부모일 때보다 아동 자녀일 때 피고인의 유죄 확률을 더 높게 평가하였으며, 피해자가 성인 자녀나 부모일 때보다 아동 자녀일 때 피고인에게 더 엄중한 형을 부과하였다. 연구 참가자의 성별 및 연령대에 따른 차이는 발견되지 않았다. 이러한 연구 결과는 연구 참가자의 개별 특성과는 관계없이 가해자-피해자 관계가존ㆍ비속 범죄에 대한 판단에 유의한 영향을 미치는 요소로 작용할 수 있음을 의미한다. 마지막으로 본 연구의 의의와 제한점에 대해 논하였다.

영문 초록

The purpose of this study was to investigate the effect of the offender-victim relationship on the perception of crime seriousness, and legal judgment in child and adult-lineal descendant and lineal ascendant crimes and to examine whether there were any differences in legal judgments by sex and age of the decision makers. Total of 336 participants between their 20s and 50s were participated and asked to make legal judgments one of three murder cases: a child-lineal descendant victim, an adult-lineal descendant victim, and an adultlineal ascendant victim. The results of the study were as follows: 1) participants perceived that lineal-descendant victim cases as more serious than lineal-ascendant case. 2) when victim is the child lineal-descendant, participants provided significantly higher guilty probability than when the victim is lineal ascendant. 3) when victim is the child-lineal ascendant, participants provided significantly higher sentences than when the victim is adult-lineal descendant or lineal ascendant. However, there were no differences on the judgment by sex and age groups of the decision makers, which suggested that perpetrator-victim relationship can significantly influences judgments on lineal-ascendant or lineal-descendant murder cases regardless of the individual characteristics of legal decision makers. Finally, implications and limitations of this study were also discussed.
