불법촬영물의 제재방안에 대한 고찰

국문 초록

이 논문은 불법촬영물에 의한 디지털 성범죄에 대해 현행법상 규제의 적정성을검토하여 미비점을 보완하면서 효율적인 대응방안을 모색하고자 하였다. 이를 위해불법촬영물의 유형을 체계적으로 분류하고 각 유형의 위험성을 분석하였다. 정보통신기술의 급속한 발전은 영상촬영장치의 소형화와 성능의 향상을 가져왔으며, 시간과 장소의 제약없이 영상이나 사진의 촬영을 가능하게 만들었다. 이는 생활 전반에 편의성을 높이는 등 긍정적인 변화를 가져왔으나, 새로운 유형의 범죄들이 빠른 속도로 증가하는 원인을 제공하기도 하였다. 이중 불법촬영물을 이용한 디지털 성범죄가 사회적 파장을 일으키게 되는데, 2020년에 발생한 ‘N번방’ 사건이그 중심에 있다. ‘N번방’ 사건은 피해자의 과반 이상이 청소년으로 밝혀져 전 국민을분노하게 만들었다. 이 사건은 디지털 성범죄를 근절하기 위한 정책들의 시행과 법률의 개정을 통해 처벌을 강화하는 계기가 되었다. 그러나 불법촬영이나 그 영상물의 제작 등과 관련된 범죄는 계속해서 증가하고 있다. 단순한 법률 개정을 통한 처벌의 강화와 다소 추상적이고 포괄적인 형태의 구성요건에 의한 광범위한 형벌주의는 문제해결을 위한 단초가 될 수 없다. 다양한 형태로 나타나고 있는 불법촬영물의 유형을 체계적으로 분석하여 그에 적합한 대응방안의 제시가 필요하다. 물론 강력한 처벌을 통한 범죄의 예방효과도 간과할 수 없기에관련 법률의 미비점을 보완하여 국민이 수긍할 수 있는 입법의 제시가 필요하다. 여기에 보다 효과적인 문제의 해결을 위해 현장에서 직접 범죄에 대응하는 수사기관의역량 강화를 위한 종합적이고 체계적인 대응체계가 필요하다. 이를 위해 불법촬영물의 유형에 따른 수사 매뉴얼의 구축과 현장 수사인력을 위한 디지털증거의 압수·수색 매뉴얼의 구비 및 수사지원 시스템의 고도화와 국내외 협력활동 및 공조수사 강화를 위한 방안에 대해 제시해 보았다. 불법촬영물을 이용한 디지털 성범죄의 경우대부분 인터넷을 활용하기 때문에 확산이 광범위하게 이루어지며, 전파속도가 빠르고 복제가 용이하다는 특징이 있다. 이러한 특징은 반복적이고 지속적인 피해를 발생시키기 때문에 피해자의 보호에 관한 문제도 절대 간과해서는 안 될 것이다.

영문 초록

This paper tried to find an effective countermeasure while supplementing the deficiencies by reviewing the appropriateness of the regulation under the current law on digital sexual crimes caused by the illegal filming. To this end, the types of illegal filming were systematically classified and the risks of each type were analyzed. The rapid development of information and communication technology has brought the miniaturization and improvement of performance of imaging devices, and made it possible to take images or photos without time and place restrictions. This brought positive changes, such as increasing convenience in life, but also contributed to the rapid increase in new types of crimes. Among them, digital sexual crimes using the illegal filming caused a social wave, and the ‘Nth Room’ incident that occurred in 2020 was at the center of it. In the case of ‘Nth Room’, more than half of the victims were found to be teenagers, so the entire nation was outraged. This incident served as an opportunity to strengthen punishment through enforcement of policies to eradicate digital sexual crimes and amendment of laws. However, crimes related to illegal filming or the production of videos are continuously increasing. Reinforcement of punishment through simply amendment of laws and broad punitiveism based on the abstract and comprehensive elements cannot be the starting point for solving the problem. By systematically analyzing the types of illegal filming appearing in various forms, it is necessary to present a countermeasure suitable for it. Of course, the prevention effect of crime through strong punishment cannot be overlooked. Therefore, it is necessary to propose legislation that the public can accept by supplementing the deficiencies in related laws. In order to solve the problem more effectively, a comprehensive and systematic response system is needed to strengthen the capability of the investigative agency to directly respond to crimes on the spot. To this end, the construction of an investigation manual according to the type of illegal filming, the preparation of a manual for seizure and search of digital evidence for on-site investigative personnel, the advancement of the investigation support system, and measures for strengthening domestic and overseas cooperative activities and investigation were suggested. In the case of digital sexual crimes using the illegal filming, most of them use the Internet, so they spread widely, spread quickly and are easy to replicate. Since these characteristics cause repeated and lasting harm, the issue of victim protection should never be overlooked.
