국문 초록

본고는 공정이나 정의와 관련하여 일반 학문 분야와 성경상의 공정과 정의를 비교･분석하였다. 본고의 연구 목적은 이 분야에서 그동안의 연구물을 정리･비교하여, 정의나 공정에 관심 있는 일반 독자 (전문 연구자가 아닌)에게 유용한 정보를 제공하기 위한 것이다. 우선 본고에서는 정의, 공정, 공의 등의 용어가 구체적으로 무엇을 의미하는 가에 대해, 법철학과 정치철학, 그리고 성경상의 내용을 분석･정리하였다. 그 결과로 이들 용어는 정의 하나의 개념에 포섭될 수 있다는 점을 밝혔다. 이러한 결론으로 본고에서는 정의 개념을 중심으로 논의를 전개하였다. 다음으로 철학에서의 정의 개념을 정리하였다. 정의의 관점에 따른 정의 개념을 정리하고, 대표적인 정의의 분류를 소개하였으며, 아리스토텔레스와 존 롤스의 정의론을 정리･소개하였다. 이어서 성경에서의 정의를 분석･검토하였다. 구약성경의 정의와 관련된 두원어 미쉬파트와 체다카의 쓰임을 분석하여 성경에서 정의 개념을 분석･정리하였다. 신약성경은 정의라는 용어를 거의 사용하고 있지는 않으나, 정의에 해당하는 원어는 사용하고 있어, 원어를 소개하고 그 내용상 정의에 해당하는 것이 있다는 것을 밝혔다. 이러한 결과를 기반으로 하여 성경상의 정의가 성경에 구체적으로 어떻게 적용되고 있는지를 응보적 정의, 배분적 정의, 회복적 정의의 관점에서 분석하였다. 결론적으로 성경상의 정의는 응보적 정의에 기초하고 있으나 배분적 정의도 중요시하고 있으며 궁극적인 목표는 회복적 정의라 할 것이다. 마지막으로, 본고는 성경상의 정의와 철학 분야 등에서의 정의를 비교･분석하였다. 성경상의 정의와 철학상 정의가 근본적으로 다른 점은, 성경의 정의는 신의 명령으로부터 기원한 것이고, 철학상의 정의는 인간의 이성에서 나온 것이 라는 점이다. 그러나 그 실천면에 있어서는 완전자유주의의 정의론을 제외한 정의는 성경의 정의와 조화할 수 있다. 특히 분배적 정의와 회복적 정의는 성경의 정의와 많은 부분 조화점을 찾을 수 있다.

영문 초록

This paper compared and analyzed the study of both philosophy and the Bible related to fairness and justice. The purpose of this study is to provide helpful information to lay readers who are interested in justice and fairness in philosophy and the Bible. First of all, this paper analyzed and clarified the meaning of justice, fairness, and righteousness in legal philosophy, political philosophy, and the Bible. As a result, this paper concluded that justice comprises the meaning of the foregoing three terms. Next, the concept of justice in philosophy was summarized, and the perspective and classification of justice in political philosophy and legal philosophy was summarized. Thereafter, organized and introduced Aristotle and John Rolls’ theory of justice. Then, this paper reviewed and analyzed the theory of justice in the Bible. Specifically, clarified the concept of justice in the Bible by analyzing the usage of the two original words mishpat and tsedaqah related to the justice of the Old Testament. This paper also confirmed that although the New Testament rarely uses the term justice, the original language corresponding to justice is found and describes justice practically in many parts. And based on the foregoing results, how the biblical justice is specifically applied to the Bible was analyzed from the perspective of retributive justice, distributive justice, and restorative justice. In summary, biblical justice is based on retributive justice, but it also emphasizes distributive justice. However, the justice that the Bible aims for untimately is restorative justice. Finally, this paper compared and analyzed the justice of philosophy and the Bible. The fundamental difference between biblical justice and philosophical justice is that the justice of the Bible originated from divine law; on the other hand, philosophical justice come from human reasoning. However, from a practical perspective, the concept of justice in Philosophy, except for that of justice of libertarians, can be in line with the Bible, especially in distributive justice and restorative justice.
