온라인수색의 법적 성격 및 헌법적 쟁점

국문 초록

온라인수색은 수사기관이 피의자의 컴퓨터 시스템의 사용자 권한 이상의 권한을 취득하거나 감시 소프트웨어를 설치하여, 피의자의 컴퓨터 시스템 내부의 데이터를 취득하는 수사기법이라고 할 수 있다. 온라인수색은 강제수사의 일종이기 때문에 강제수사법정주의에 따라 법적 근거가 필요하다. 하지만 온라인수색은 통신비밀보호법상의 감청 개념에 포섭될 수는 없다. 한편, 온라인수색을 형사소송법상의 압수수색에 포함하기에도 무리가 있다. 따라서 온라인수색을 통해서 취득한 증거가 증거능력이 있으려면별도로 온라인수색을 입법해야 할 것이다. 온라인수색의 방법으로 피의자의 컴퓨터 시스템의 사용자 권한 이상의 권한을 취득하는 방법과 메일이나 문자 메시지 등을 통해 감시 소프트웨어를 설치하게 한다면, 과잉금지원칙의 하부원칙인 피해의 최소성 및 법익의 균형성에 위배될 소지가 있다. 한편 온라인수색의 대상 범죄를 제한할 필요성이 있다. 또한 사후 절차로서 정당한 고지와 이에 대한 의견 제출을 허용해야 할 것이다.

영문 초록

Online search can be said to be an investigative technique in which an investigative agency acquires more than the user’s authority of the suspect’s computer system or installs monitoring software to acquire data inside the suspect’s computer system. Since online search is a kind of forced investigation, legal grounds are needed. However, online search cannot be called eavesdropping under the Communications Secret Protection Act. On the other hand, it is difficult to include online search in the seizure and search under the Criminal Procedure Act. Therefore, online search should be legislated separately. Acquiring more than user rights of the suspect’s computer system for online search and having the monitoring software installed through mail or text messages are not acceptable. On the other hand, there is a need to limit the crimes subject to online search. In addition, as a follow-up procedure, a legitimate notice and opinions on it should be allowed.
