피해자 의사존중과 강제개입의 논쟁을 통해 살펴본 가정폭력 대응정책의 한계 및 변화의 방향

국문 초록

본 연구는 가정폭력 대응정책이 보다 강력하게 피해자를 보호하고 엄중하게 가해자를 처벌해야한다는 사회적 움직임을 바탕으로 한국 사회에서의 피해자 의사존중과 강제개입의 논쟁을 검토하였다. 가정폭력처벌법을 통해 명시되어 있는 피해자 의사존중과 의무체포제･강제기소제를 중심으로 한강제개입의 논쟁을 통해 가정폭력 대응정책의 실효성과 한계를 분석한 결과는 다음과 같다. 가정폭력의 맥락과 피해자의 의사결정과정에 대한 이해가 부재한 가운데 기계적 의사존중은 가정폭력 사건처리를 피해자에게 의존, 그 책임을 피해자에게 떠넘기는 결과를 초래하였고 또한 경찰의 적극적개입을 저해하며 오히려 피해자 보호를 어렵게 만들었다. 특히 피해자 의사존중은 가정보호사건처리라는 한국적 특수성과 맞물려 피해자를 보호하는 것이 아닌 가해자를 처벌로부터 보호하는 방향으로 작동됨을 볼 수 있었다. 이를 바탕으로 피해여성의 권한강화, 경찰의 적극적 대응, 강제개입정책의 도입, 가해행위에 대한 엄중 처벌, 가정폭력처벌법 목적조항의 이중성 등을 논의하였다. 궁극적으로 적극적인 사법적개입을 통해 가정폭력은 엄중한 처벌을 받는 범죄행위라는 메시지를 분명하게 제시할 수 있는 방향으로 정책이 강화되어야 할 것이다.

영문 초록

This study aimed to review the debates between mandatory intervention for domestic violence(mandatory arrest and no-drop policies) and a victim-choice policy and tried to suggest future directions for change. Controversy over the forced intervention policy was analyzed focusing on the effectiveness and limitations of the mandatory arrest and prosecution systems. It was also examined whether victims’ choices were guaranteed well enough by the Act on Special Cases Concerning the Punishment of Crimes of Domestic Violence. The result showed that it could be ended up shifting the responsibility of domestic violence to the victim without understanding the victim’s situation and decision-making process. Victim-choice policy in Korean even hindered the police’s active intervention and made it difficult to protect victims. Also, when a victim-choice policy was provided with family protection cases, it would work in the direction of protecting the perpetrator from punishment, rather than protecting the victim. It further discussed victimized women’s empowerment, the police’s active response, the possibility of mandatory intervention, proper punishment for domestic violence, and so on.
