국문 초록

이 연구는 교원 연가와 학교장 승인의 법적 성질과 교사 연가 불허 사유의 과잉금지 원칙 위반 여부를 검토하였다. 교원 연가는 교원 외 공무원, 일반 근로자에 비해 과도한 제한을 받고 있는데, 이와 관련하여 교원만의 특수한 복무제도인 교육공무원법 제41조 연수의 성격과 연가와의 관련성을 평가하였다. 학교장은 교원휴가에 관한 예규에서 정한 교원 연가의 사유가 인정되더라도 학교업무와 교육과정 운영에 지장을 초래하지 않는 범위에서 승인한다는 교육부의 유권해석은 과잉금지 원칙에 위배되므로 이에 대한 개선 방안을 제시하였다. 앞으로 학생의 학습권 보장과 교원의 연가 사용권의 조화로운 공존을 위한 교직문화의 개선, 제도, 정책이 필요하다.

영문 초록

This study is to find legal implications of korean teacher’s annual leaves and principal's approval. Teachers' annual leave is discriminated against compared to public officials and general workers. There is an opinion that such restrictions and discrimination under the Education Act are justified due to the teacher’s training days of Article 41. However, (Article 41) training days of teachers is for the implementation of teachers' self-training obligations to guarantee students' rights, so teacher’s annual leaves is different from that because it has the compensatory meanings of hard working last year and teacher’s right to rest. Based on the Article 41 of teacher trainig datys, excessive restrictions on teacher annual leaves are not justified. As a reason for the principal's disapproval, the legitimacy of the purpose of school work and curriculum operation was recognized, but it was judged that it violated the anti - overrestriction principle because it could not affirm the appropriateness of the method and the minimum of damage. For the harmonious coexistence of students' right and teachers annual leave, it was proposedto interpret the reason for not allowing annual leave as regular classes, urgent accidents related to student safety and health guidance and counseling.
