국문 초록
본 연구는 가족기업이 비가족기업에 비하여 어떠한 조세회피 성향을 가지고 있는가와 가족기업의 특성에 따라 가족기업의 조세회피 성향에 차이가 있는가를 검증함을 목적으로 한다. 가족기업은 전세계적으로 산업에서 차지하는 비중이 매우 높고, 그에 따라 해외에서는 활발한 연구가 진행되나, 국내에서는 가족기업의 중요성에 대한 인식의 미비로 인하여 관련 연구가 매우 미비한 상황이다. 따라서 본 연구는 2000년부터 2005년까지 총 6년간의 비금융 상장제조업체를 대상으로 본 연구에서 정의한 3가지 방법에 따라 가족기업과 비가족기업을 구분하였고, 해당 기업의 조세회피 성향을 Desai and Dharmapala(2006)의 방법을 국내 상황에 맞게 수정하여 측정하여 연구를 진행하였다. 분석결과 첫째, 가족기업은 비가족기업에 비하여 낮은 조세회피 성향을 나타냈다. 이는 가족기업은 비가족기업에 비해 조세회피로 인한 세금절감 등의 혜택보다는 조세회피로 인한 가족기업의 명성훼손, 주가하락 등의 비용을 크게 인식하고 있기 때문인 것으로 판단된다. 둘째, 가족기업의 특성에 따라 조세회피 성향에 차이가 존재하는가를 검증한 결과, 조세부담수준이 높을 경우에는 조세회피로 인한 효익이 비용보다 크기 때문에 가족기업 역시 높은 조세회피 성향을 보였다. 반면 감사인이 Big 4 회계법인 경우와 사외이사 비율이 높은 가족기업은 높은 조세회피 성향을 보였다. 이는 가족기업에 있어서는 Big 4 회계법인의 감사서비스가 기업의 조세회피 성향을 낮추기 보다는 감사를 맡고 있는 Big 4 회계법인으로 부터 오히려 높은 수준의 치밀한 세무서비스를 제공 받기 때문인 것으로 해석되고, 사외이사 역시 소유와 통제력이 강한 가족기업에 있어서는 가족구성원과 사외이사 간의 유착관계로 인하여 사외이사가 기업의 조세회피 성향을 적절히 통제하기 못하기 때문인 것으로 해석된다.
영문 초록
In this study, we examine the tax aggressiveness of family firms, relative to their non-family counterparts. We also examine if the characteristics of family firms affect on their tax aggressiveness. As a unique type of public company, a family firm is likely to face different types of agency problems from a non-family firm. Compared to non-family firms, family firms face less severe agency problem due to the separation of ownership and management, but more severe agency problems that arise between controlling and non-controlling shareholders. Family ownership and control is dominant among publicly traded firms throughout the world. Many studies in other countries have examined these characteristics of family firms. Few studies, however, have researched for family firms in Korea. Using a book-tax difference measure, developed by Desai and Dharmapala(2006), to capture tax aggressiveness, we find that a family firm is less tax aggressive than a non-family firm in Korea. This result suggests that family owners are willing to forgo tax benefits in order to avoid the non-tax cost of a potential penalty and reputation damage. Our results are consistent with prior studies’ findings that overall, family entrenchment is not a serious concern in Korean family firms, like in U.S. family firms(Anderson and Reeb 2003;Wang 2006;Ali et al. 2007). Moreover, since a book-tax conformity for Korean firms is higher than one for U.S. firms, the more tax aggressive family owners are, the more decreasing their book income is. As for characteristics of a family firm, we find that a family firm which has a higher tax burden, big 4 auditors, or higher outside directors is more tax aggressive. Our results suggest that family firms with high quality of audit service are provided with a high level of tax planning. We suggest that outside directors who are related closely with family owners do not play a role of effective monitors in that these outside directors do not reduce the rent extraction of family owners.
