정전협정(1953)의 주요내용과 쟁점분석

국문 초록

정전협정은 남북한이 최초로 체결한 군사적 성격을 가진 협정이라고할 수 있다. 정전협정 체제가 60년이 넘어서고 있는 현재까지 정전협정의 발전적 미래가 불투명하다는 것이 문제이다. 정전협정의 의미 및역할에 대한 평가를 보면 양면성을 가지고 있는 관계로 객관적인 결론을 도출하기 어렵다고 할 수 있다. 먼저 긍정적인 측면을 보면 정전협정이 전쟁을 중단시키고 전쟁을 억제할 수 있는 기능과 역할을 한 반면에 부정적인 측면을 보면 정전협정은 한반도의 분단을 고착화시키고 새로운 체제로의 전환을 시도하지 못하였다고 있다고 할 수 있다. 다시말해서 정전협정을 제대로 이행하였다면 오늘날까지 분단이 지속되지않고 새로운 체제로 전환을 하였을 가능성이 크다는 의견이다. 정전협정을 준수하지 못한 무능력함은 이해 당사자들의 책임인 동시에 향후과제라고 할 수 있다. 본 논문에서는 정전협정에 대한 내용 분석을 바탕으로 정전협정이 가지고 있는 의미와 역할에 대해 분석한 다음, 정전협정의 주요 쟁점 문제들이 무엇인가를 살펴보고자 한다. 마지막으로정전체제의 평화제로의 전환과정에서 고려하여야 할 전제조건, 향후 방향과 한계에 대한 분석결과를 후속과제로 제시하고자 하는 것이 본 논문의 목적이라고 할 수 있다.

영문 초록

The 1953 Armistice Agreement has been considered the first military pact signed by war parties on the Korean Peninsular. Over the past 60 years after the ratification of armistice, the future of the armistice has still been unclear. Indeed, mixed views on the role and meaning of the cease-fire agreement make us unwilling to draw an objective conclusion. It has played an important role in halting and deterring a war while it has perpetuated the division of the Korean Peninsular and prevented from converting a peace regime. In other words, if the war parties abide by the pact, they could end the division and transform the armistice into a peace regime. Therefore, the unenforced implementation of the agreement is the responsibility of the parties as well as the future tasks to settle. Conducting content analysis of the armistice agreement, this article analyzes the meaning and role of the pact and addresses the main issues of the pact. Then, the paper shows the content analysis results and figures out the preconditions of transforming the armistice into the peace regime. Finally, the paper uncovers the implication and limitation of this research and suggests recommendations for further study.
