남북통일과 지방분권을 위한 분권형 개헌논의 연구

국문 초록

진정한 의미의 분권적 민주주의가 제10차 개헌과정에서 담보되기 위해서는 남북통일과 지방분권이라는 권력의 지역적 분산과 공유를 포함하는 포괄적인 분권형 개헌이 이루어질 필요가 있다. 본 연구는 이러한문제의식 아래 헌정제도 상 권력구조의 문제점과 함께 그런 문제점을극복하기 위해 왜 이 시점에서 분권형 개헌 논의가 필요한 지에 대해살펴본다. 또한 현재 진행되고 있는 분권형 개헌논의가 지닌 문제점을지적하면서 바람직한 분권형 개헌논의의 방향을 제시한다. 아울러 남북통일과 지방분권을 지향하는 바람직한 개헌논의가 이루어지기 위해서현재의 권력구조 개편에 대한 논의가 어떤 방향으로 수렴될 필요가 있는지를 살펴본다.

영문 초록

There needs to be a comprehensive decentralized Constitutional amendment in order to reflect the true meaning of decentralizing democracy into the process of the 10th Constitutional amendment. In this context, this research attempts to explore some necessities of discussion about decentralized Constitutional amendment at this specific period of time so as to overcome all the problems related to the power structure of our Constitution. In addition, it not only provides the direction of discussions on the right way of decentralized constitutional amendment but also reveals the impending problems of current discussions on decentralized Constitutional amendment. This research finally ends up with exploring the desirable converging direction of readjustment of current power structure pursuing South-North reunification and local decentralization.
