북한시장에서 재산권의 보호 메커니즘

국문 초록

1990년대 이후 대규모 경제난과 함께 출현한 북한의 자생적 시장은양적인 팽창을 거듭하며 발전하고 있다. 본 연구는 20여년간 발전을이어온 북한시장의 질적인 부분의 변화에 집중하여 북한시장에서 발생하는 재산권의 사적침해와 보호의 메커니즘을 밝혀보았다. 우선 North 의 재산권 이론을 기반으로 시장거래에서 발생하는 재산권의 침해와 보호를 설명하고, 북한시장 재산권의 사적침해와 보호를 다룬 기존연구를분석했다. 이어서 시장경험이 있는 북한이탈주민에게 실시한 심층인터뷰 자료를 바탕으로, 북한시장에서 공식제도의 실효성, 비공식제도의작동, 공식제도와 비공식제도의 관계를 분석했다. 분석결과, 북한시장에서 재산권의 사적침해를 보호하는 공식제도는 취약한 것에 비해 자조, 신뢰, 뇌물, 인맥, 권력과의 관계, 평판, 보복, 명성, 상부상조 등과 같은 비공식제도는 매우 강하게 작동하는 것으로 드러났다. 북한시장은 공식제도가 미비한 상태에서 비공식제도가 공식제도의 역할을 대신하는 형태로 발전되고 있으며, 양자 간의 관계를 명확히 파악하는 것은 북한시장을 이해하는데 중요한 요소임을 밝힐 수 있었다. 향후 북한시장의 발전을 위해서는 공식 제도의 실효성 제고, 시장에 대한 정부의 정치적 통제 완화, 비공식제도의 특성을 고려한 공식제도의 점진적 적용과 같은 제도적 개편이 필요함을 제안했다.

영문 초록

Since the 1990s, a market has been created in North Korea due to the large-scale economic crisis, and the market has been expanded across the nation. This study identifies the mechanism of property rights protection against private infringement of the rights in the North Korean market. To begin with, this study explains the infringement and protection of property rights based on Douglass North’s theory of property rights. And it analyzes existing literature which examines the operational mechanism of the North Korean market and drives out a few research questions. For empirical analysis, in-depth interviews were conducted for North Korean defectors to evaluate the effectiveness of the formal institutions and to identify the types of informal institutions under operation. The empirical analysis found that the formal institutions to protect private property rights in the North Korean market are weak, whereas the informal institutions such as self-help, trust, bribes, personal connections, relationships with power, reputation, retaliation, reputation, and mutual aid work very strongly. For the future development of the North Korean market, we suggest that institutional reforms such as enhancing the effectiveness of the formal institutions, easing the government’s political control over the market, and gradual application of the formal institutions taking into account the characteristics of the informal institutions are necessary.
