국문 초록

우리 사회는 이미 분쟁 사회라 해도 과언이 아니다. 2010년 이후 지금까지 매년 접수된 소송사건은 대략 6백만 건이 넘어서는 등 재판을 통한 분쟁해결은 이미 포화상태에 이르렀다. 재판의 기능적인 역할이 사회적인 통합과 관련한 제도, 기구, 절차 등에 미진한 부분들이 많았음을 반증한다. 또 이러한 사법 기능의 보완을 위한 선진화된 자본주의 국가에서 진행되는 ADR이 우리 사회에도 지난 60여 년 동안 실시되었다. 그러나 법률소비자의 ADR 이용률이 늘어나지 않은 배경에는 그것의 인식 부족과 관련한 충분한 촉진이 이뤄지지 않은 정부의 활동도 무시할 수 없다. 우선 종합적인 ADR 기본법이 제대로 마련되어 있지 않으며, 조정전치 제도로서 조정의 80% 이상이 수소법원을 중심으로 이뤄지고 있다. 행정형 ADR은 기관 간에 법률적 근거 및 절차를 달리하며, 소통이 잘 이루어지지 않는 비효율성을 나타낸다. 그리고 민간 ADR의 활동 역시 제대로 이루어지지 않고 있는 실정이다. 이러한 것들은 ADR의 근본적인 이념과 목적에 비추어 비판의 배경이 될 수밖에 없다. ADR과 관련한 승가의 율장은 공동체의 운영에 관한 별도의 방식이다. 그것은 개인윤리와 조직윤리, 공동체 생활과 활동에 관한 여법한 심의과정, 일어날 만한 사쟁(四諍)에 관한 멸쟁법을 담은 율장의 불교적 불쟁해결(BDR, Buddhist Dispute Resolution) 방식이다. 율장에는 BDR의 원리와 체계를 가지고 있으며, 이는 현전승가(現前僧伽), 사방승가(四方僧伽)가 오늘날까지 여법한 화합으로 계승 및 발전하는 충분한 배경이 되어주었다. 이러한 특징으로 법(法)·율(律)·불설(佛說)의 교설이 명확하고, 일상생활을 비롯한 각종 의식과 행사, 분쟁 등에 따른 제도 및 진행과 절차는 여법한 갈마를 통한 합리적인 운영 체계를 나타낸다. 특히 분쟁이 발생하면 7멸쟁법(滅諍法)을 통하여 현전비니에 따른 투명한 공정성과 만장일치로 분쟁의 소지를 최대한 극복하였다. 승가는 여법한 갈마, 참회, 승복 등으로 ADR의 사적자치를 추구하며 승가 화합의 통합적 기능을 잘 유지 계승해 왔다.

Religion has a very close relationship with our everyday lives. In particular, religion maintains an absolute and ultimate value system and is deeply associated with all sectors of society such as politics, economy, thought, arts, culture, and science. The original meaning of religion in Buddhism means the teachings that become fundamentals. There are numerous religions around the world, and each religion has its own object of faith, different system, and unique rites and lifestyles. Therefore, evaluating or denouncing other regions based on the doctrines or conventions of a specific religion can lead to conflicts and disputes. The Buddhist Vinaya Pitaka related to alternative dispute resolution (ADR) is a method regarding the operation of a community. Vinaya Pitaka contains Buddha’s teachings about individual and organizational ethics and on community life and activities. It is the Buddhist dispute resolution (BDR) of the Vinayata Pitaka that contains knowledge on how to remedy disputes among the four types of disputes that can occur. Vinaya Pitaka contains the principles and systems of BDR, and it is sufficient background for succeeding in the development of harmony today. The messages of laws, ethics, and Buddhist teachings are clear in these characteristics. The systems, progress, and procedures for various rites, events, and disputes as well as for everyday life, etc. display a rational operating system through karma. In particular, when disputes occur, the cause of the dispute is resolved as much as possible through transparent fairness and being unanimous using the seven remedies for disputes. Buddhist priests pursue private autonomy of ADR through karma, repentance, acceptance, etc. to maintain and continue the integrated functions of Buddhist priest harmony.
