실정법철학의 가능성과 방법

국문 초록

최근 법철학을 포함하는 기초법학이 위기에 처해 있다는 목소리가 여기저기서 들린다. 특히 학문후속세대가 제대로 성장하기 못해 기초법학이 고사될 수 있다는 주장이 설득력 있게 주장된다. 그 때문에 위기에 처한 법철학을, 기초법학을 구해내고자 하는 노력과 시도가 진행된다. 법철학과 같은 기초법학이 위기에 처하게 된 이유로는 여러 가지를 언급할 수 있다. 법학전문대학원 체제도 한 몫을 하는 것으로 보인다. 법학전문대학원 체제가 원래 추구했던 목표와는 달리 운용되면서 여러 부작용이 등장하는 것이다. 그중 가장 눈에 띄는 현실로 법학전문대학원에서 이루어지는 법학교육이 변호사시험에 심하게 종속되고 있다는 것이다. 이로 인해 법철학을 포함한 기초법학이 변호사시험 과목에서 배제되면서 법철학은 법학전문대학원 체제에서 급속하게 힘을 잃고 있다. 이러한 위기 상황에서 어떻게 하면 법철학의 학문적 위상을 복원할 수 있는지가 절박하게 논의된다. 이에는 여러 가지 방안을 고려할 수 있다. 이 글은 그중 한 가지로 법철학에 대한 접근 방법을 새롭게 모색하는 것을 제안한다. 철학에 기반을 두어 법학에 접근하는 전통적인 법철학과는 달리 실정법이나 판례에 더욱 친화적인 법철학을 모색하는 것이다. 이러한 예로 이 글은 ‘실정법철학’을 언급한다. 여기서 실정법철학이란 실정법 또는 실정법학을 출발점으로 하여 실정법의 철학을 탐구하는 법철학의 하부 분과로 규정할 수 있다. 실정법철학은 실정법학이 기초로 삼는 기본 개념이나 체계, 원리 등이 무엇인지를 규명하는 법철학의 분야로 이해할 수 있다. 요컨대 법철학과 같은 기초법학이 아닌 실정법학 내부에서 자신에게 적합한 법철학을 모색하여 형성된 것이 실정법철학이다. 이 글은 민법학에서 이루어진 논의를 예로 하여 실정법철학이 어떻게 가능할 수 있는지를 모색한다. 특히 민법학자 권영준 교수가 전개한 민법학의 기본원리를 분석함으로써 실정법철학의 가능성을 탐구한다. 그중에서도 불법행위에서 금지청구권을 인정할 수 있는지에 관한 문제를 통해 실정법철학이 어떤 논증을 구사하는지 살펴본다. 이를 통해 현재 법철학이 처한 위기를 극복할 수 있는 한 가지 방안을 탐색한다.

영문 초록

Recently, voices are heard everywhere that basic law is in crisis. In particular, it is convincingly argued that basic law may be in crisis because the next generation of academics in basic law will not grow properly. A great crisis can be found across all academic disciplines and across the university. The following aspects also contributed to the crisis of law. Side effects appear as the law school system is operated differently from the original goal in South Korea. The most striking reality among these is that law education at law schools is subordinated to the bar exam. As the bar exam is strongly oriented toward practical ability, the negative effects of law education at law schools are emerging. As a result, basic law, including the philosophy of law, was excluded from the bar exam subjects, and the philosophy of law is rapidly losing power in the law school system. In this crisis situation, how to restore the academic status of the philosophy of law is urgently discussed. Several approaches can be considered for this. This article proposes a new approach to the philosophy of law as one of them. Unlike the traditional philosophy of law, which approaches law based on philosophy, the new approach seeks a philosophy of law that is more friendly to positive law or precedent. As an example, this article refers to the ‘positive law philosophy’. Here, positive law philosophy can be defined as a sub-division of legal philosophy that explores the philosophy of law with positive law as the starting point. Positive law philosophy can be understood as a field of legal philosophy that examines the basic concepts, systems, and principles that positive law studies are based on. This article explores how positive law philosophy can be made possible by taking the discussion made in civil law as an example. In particular, the possibility of positive law philosophy is explored by analyzing the basic principles of civil law developed by civil law scholar professor Kwon, Youngjoon. Among them, this article examines what kind of argument the positive law philosophy uses through the question of whether the right to claim for injunction can be recognized in torts. Through this, one way to overcome the current crisis of the philosophy of law is explored.
