국제분쟁 해결수단으로서 싱가포르 조정협약의 주요 쟁점

국문 초록

국제적 성격의 조정을 통해 도출된 합의서에 대한 제3국에서의 집행을 위한 국제협약의 채택은 그 선례가 없는 새로운 시도이다. 2018년 7월 문안이 확정된 이 협약은 2019년 8월 싱가포르에서 서명이 추진되고 있다. 그 이후 2020년경 이 협약이 발효할 것으로 예상된다. 최초의 시도인 만큼 발효 후 이 협약의 여러 조항이 실제 어떻게 적용되는지를 면밀히 살펴보면 여러 국가들이 현재 갖고 있는 여러 의문점이 해소될 것으로 보인다. 아직은 이 협약이 1958년 뉴욕협약에 버금가는 새로운 국제체제를 도입할 수 있을지는 불투명하다. 그러나 일단 이 협약은 최근 국제거래에 참여하는 여러 주체들의 요구에 따라 도입되었으므로 상황에 따라서는 빠른 속도로 확산될 가능성도 적지 않다. 우리 입장에서는 앞으로 이 협약이 어떻게 적용되는지 여부를 일단 살펴보는 것이 필요하다. 특히 현재 협약이 제시하고 있는 내용들 중 일부는 우리 법제와는 부합하지 않는 부분도 있는 것으로 보인다. 이 글에서는 일단 그러한 부분을 확인하고 분석하는 데 초점을 맞추었다. 만약 국제거래에 나서는 우리 개인과 기업들도이러한 새로운 국제 집행 제도를 필요로 하는 상황이라면 우리 법제도 이에 맞추어 변경 내지발전시킬 필요가 있을 것이다. 그 경우 일단 모델법안을 참고하여 우리 국내법령에 이를 반영하고, 추후 필요에 따라 동 협약 가입여부도 검토해 볼 수 있을 것이다.

영문 초록

Today’s society appears to be entering a hyper-connected society due to mental notions and information communication technologies being converged for advanced development. Trade between countries around the world is increasing amidst the digital economy and fourth industrial revolution, which is being accompanied by a growing number of trade disputes. Appropriately resolving disputes is crucial for corporate growth, and ADR is drawing attention as a more reasonable solution between interested parties compared to lawsuits. This also applies to international trade as there is growing movements to resolve disputes between parties more efficiently and feasibly through mediation. The adaptation of an international convention for implementation in a third country for settlement agreements drawn up through such international mediation is a new and unprecedented attempt. In other words, the Singapore Convention on Mediation looks to resolve international commercial disputes by granting executive force on the outcomes of mediations.
