VR융합형 유원시설 영상물 등급분류의 법적 문제와 개선과제

국문 초록

디지털 기술의 발달로 가상증강현실(VR/AR) 및 확장현실(XR)의 기술들이 유원시설 내의 유기시설·기구에 접목되고 있다. VR융합형 유원시설 영상물의 이용자들은 이를 즐기고 있으며, VR융합형 유기시설·기구에 대한 수요도 증가하고 있다. 그러나 VR융합형 영상물을 유기시설·기구에 탑재하고자 하면, 유원시설 내에서 이루어져야 하지만, 유원시설을 규제하고 있는 관광진흥법에서는 관련 규정을 찾을 수 없고 시행규칙의 별표에서 관련 규제를 발견할 수 있다. 유원시설업을 영위하면서 VR융합형 영상물을 제공하고자 할 때에는 제공 대상 영상물을 게임물 또는 영상물의 등급분류심사를 받고 등급을 취득하여야 한다. 그리고 관광진흥법 시행규칙은 별표에서 게임물 혹은 영상물 중에서 어느 쪽 관련 법률에 의하여 등급을 받든지 ‘전체이용가’ 등급을 받은 게임물이나 영상물만 유원시설에서 활용할 수 있도록 규정하고 있다. 그러나 VR융합형 영상물이 시뮬레이터 혹은 어트랙션에 탑재되어, 서비스될 때에는 현행 등급분류심사 기준인 안전성 외에도 영상물의 등급분류 기준에 포함되어 있지 않는 시력저하와 사이버 멀미 등의 부작용이 발생할 수도 있다. 즉, 현행 등급분류체계는 VR융합형 유원시설 영상물의 특수성에서 비롯된 정신적·심리적 손상의 우려 등을 도외시하고 있다. 그러므로 유원시설의 VR영상물에 대한 새로운 기술이 반영된 유기시설·기구의 고유한 등급분류체계가 필요하다. 이러한 취지에서, 본 글에서는 유원시설 규제의 태동을 살펴보고(Ⅱ), 유원시설 VR영상물의 규제현황과 게임물과 영상물의 등급분류제도를 분석하고(Ⅲ), 현행 VR융합형 유원시설 영상물의 특성과 등급분류제도의 문제점을 기술하며, 미래지향적 발전방안으로서, 점진적이면서도 민간자율적인 등급분류로의 방향과 독자적인 기준과 체계를 형성할 것을 제안하고자 한다(Ⅳ). 구체적인 개선과제로는 VR융합형 영상물과 시뮬레이터가 하나로 결합된 유기시설․기구이기에 독자적인 등급분류 기준, 등급분류 운영체계 그리고 자율등급분류정보시스템이 필요하다. 나아가 표현의 자유와 영업의 자유를 최대한 보장하는 측면에서는 네가티브규제의 일환으로 표준화와 인증제도를 도입하여야 한다.

영문 초록

With the advancement of digital technology, virtual and augmented reality (VR/AR realism) and extended reality (XR) technologies are being grafted into organic facilities and equipment in amusement park facilities. Users are enjoying the VR convergence amusement facility videos, and the demand for VR convergence organic facilities and equipment continues to grow. However, if VR convergence video material is to be mounted on an organic facility or device, there is no related regulation in the Tourism Promotion Act, which regulates the amusement facility. If you want to provide VR convergence-type video products while operating an amusement park business, you must obtain a grade after undergoing a rating classification review for the video game product or video product to be offered. In addition, the Enforcement Rules of the Tourism Promotion Act stipulate that only game products or video products with a rating of “all users” can be used in amusement facilities, regardless of whether they are rated according to the relevant laws among game products or video products in the attached table. However, when VR convergence video materials are loaded into simulators or attractions and serviced, adverse effects such as reduced visual acuity and cybersickness may arise. The current classification review standards do not cover these adverse effects. In other words, the existing classification system ignores concerns about mental and psychological harm caused by the specificity of VR convergence-type amusement facility videos. Therefore, a unique grading system for organic facilities and equipment is required that takes into account new technologies for VR video content in amusement park facilities. To that end, this article analyzes the nascent period of the regulation of amusement facilities, the regulatory status of VR video materials at amusement facilities, the classification system for games and videos, and the current VR convergence type video content. It discusses the characteristics and shortcomings of the classification system. As a future-oriented development plan, it intends to propose a path toward a gradual and private autonomous rating classification, as well as set up an independent standard and system. In conclusion, it is an organic facility and device in which VR convergence video material and simulator are combined into one. Therefore, an independent classification standard, a classification operating system, and an autonomous classification information system are required. In addition, in terms of maximally guaranteeing freedom of expression and business, standardization and certification systems may be considered as part of negative regulation.
