뉴노멀 시대의 헌법 상 기본권 규정의 개정 방향

국문 초록

코로나 사태로 모든 일상에 디지털 대전환이 일어나는 온택트의 흐름은 코로나 사태 이전과 이후의 사회를 극명하게 갈라 놓았다. 코로나 사태가 유발하는 사회적 충격의 강도와 그 충격의 지속성과 변화를 힘은 뉴노멀이라고 불리는 새로운 사회의 모습을 가지게 될 정도로 강력하다. 4차 산업혁명으로 대변되는 첨단 과학기술의 약진과 맞물려 뉴노멀의 사회에서는 이전보다 강화된 기본권 보장 체계에 대한 검토를 요구한다. 헌법 학계에서 실시한 설문조사에서도 나타나듯이, 향후 헌법 개정의 기회가 온다면 뉴노멀 시대에 대응하는 시대 정신을 반영하여 기본권을 강화하는 방향으로 기본권 목록의 개정이 이루어질 필요가 있다. 본고는 대한민국 헌법 제정 이후 학계와 판례로 지속적으로 논의되고 기본권으로 자리매김하였으나 기본권 목록에 명문화되지 않은 새로운 기본권들을 헌법 조문으로 반영하고 현행 조문의 개선점을 검토하여 기본권 규정의 개정 방향을 제시하였다. 기본권 주체를 규정하는 문제, 기본권의 대국가적 대사인적 효력, 포괄적 기본권으로서 인간의 존엄과 행복추구권 그리고 열거되지 아니한 권리를 명시한 조항에 대한 개선점에 대한 검토로부터 시작하여, 뉴노멀 시대에 더욱 중요성이 더해지는 생명권, 정신적 자유권, 안전권, 정보기본권, 건강권, 학습권 등의 신설을 제안하였다.

영문 초록

The flow of Ontact, where digital transformation takes place in all daily life due to the COVID-19 crisis, has sharply divided society before and after the COVID-19 crisis. The strength of the social shock induced by the COVID-19 crisis, the persistence of the shock, and the power to change are strong enough to have the appearance of a new society called the new normal. In line with the advancement of advanced science and technology represented by the 4th industrial revolution, the new normal society requires a review of a system for guaranteeing basic rights that is stronger than before. Focusing on the fundamental rights that reflect the spirit of the times in response to the new normal era, this paper reflects the new fundamental rights that have not been stipulated in the list of basic rights, which have been continuously discussed with academia and precedent since the enactment of the Republic of Korea Constitution, and have been established as basic rights. Starting with a review of the issues that define the subject of constitutional rights, the effect of fundamental rights on the State and among individuals, and the improvements to the provisions that specify human dignity and the right to pursue happiness as comprehensive basic rights, and rights that are not enumerated, the new regulation of the right to life, the right to mental freedom, the right to safety, the basic right to information, the right to health, and the right to learn were newly proposed.
