문화정책의 참여적 거버넌스 원칙 정립을 위한 법률 분석 연구

국문 초록

본 연구의 목적은 문화정책의 참여적 거버넌스가 실질적으로 실천되어 정책의 수립 및 결정 과정에서 문화 향유자의 주체인 시민과 더불어 문화 공급의 다양한 주체들이 함께 참여할 수 있는 법적 근간을 마련하기 위한 방향을 탐색하는 데 있다. 이를 위해 본 연구는 정책수단으로써의 참여와 참여적 거버넌스의 형태에 대한 선행연구를 고찰하고, 현재 국내 문화정책에서 시민을 비롯한 다양한 주체의 공식적인 참여적 거버넌스가 실현되는 데 여전히 한계가 존재함을 파악하였다. 나아가 문화 외 분야 기본법 64개와 문화정책의 근간이 되는 기본법, 진흥법, 규제법 등 43개 법률의 내용들을 분석하여 현재 문화 분야 법률에서 참여의 대표적 형태인 정보공개, 의견수렴, 공동결정을 실천하고자 하는 법적 근거가 어느 정도 마련되었는지 분석하였다. 분석 결과, 문화 분야 법률들은 다양한 참여의 행위들을 실행할 수 있는 의무 사항들을 제대로 법에 포함하고 있지 않았으며, 특히 의견수렴 및 정보공개와 관련한 내용이 문화 외 분야에 비해 상대적으로 적게 나타났다. 그러므로 문화정책에서 참여적 거버넌스가 실질적으로 더욱 활발히 이루어지기 위해서는 참여의 대상 중 문화 향유자인 일반 시민의 중요성을 재인식해야 한다. 또한 정책의 가장 중요한 대상 집단의 의견이 수렴되기 위해, 해당 집단과의 협력, 협조 등을 권고하는 조항을 법률에 담아야 한다. 나아가 정부의 의무적 정보공개 외에도 국민의 청구에 의해 정책에 대한 정보공개가 이루어질 수 있는 내용이 문화 분야 법률에도 필요하다. 마지막으로 의견수렴과 실제 정책결정에까지 시민뿐만 아니라 다양한 집단들의 의견이 공유될 것을 법률에서 보장할 수 있도록 해야 한다.

영문 초록

The purpose of this study is to explore the direction that participatory governance of cultural policy is practically implemented to lay the legal foundation for citizens, who are the subjects of cultural enjoyment, to participate in the process of establishing and determining policies. To this end, this study reviewed literatures on participation as a policy instrument and types of participatory governance and identified that participatory governance is not currently being properly implemented in cultural policy in Korea. Furthermore, the contents of 64 fundamental Acts in non-cultural areas, and 43 Acts including promotion laws, regulation laws, and protection laws, were analyzed to determine how much public information, collection of public opinion, and shared decision making were prepared for participatory governance. According to the analysis, cultural laws did not properly include obligations to implement various participatory activities, and in particular, collection of public opinion were less specific than those related to non-cultural areas. Therefore, in order for participatory governance to be more active in cultural policy, an institutional framework and arrangement is needed to emphasize the importance of ordinary citizens, who are participants, as well as cultural providers. In addition, in order to collect opinions from the most important target groups of policies, provisions recommending cooperation with the groups must be included in the law. Furthermore, in addition to the mandatory disclosure of information by the government, information on policies at the request of the people is also necessary for cultural laws. Finally, the law should ensure that opinions from not only citizens but also various groups will be shared, including collecting opinions and actual policy decisions.
