국문 초록

분단국가의 법제통합은 서로 다른 정치⋅경제 체제하에서 장기간 분리 존속해오던 복수의 법체계를 하나로 통합하는 것으로 단순한 법제도적 통합 이상의 복잡한 과정이다. 본 논문에서는 통일 한국에서의 남북한 법제통합 과제의 측면에서 북한과 중국의 법체계 특수성을 이해하고 그 문제점과 해결책 찾는 연구를 진행하였다. 북한과 중국의 법체계는 사회주의 법계를 기초로 하여 자본주의 법계와는 다른 발전 과정을 거치고 있다. 특히 법에 대한 이념적 기초, 용어상의 차이, 사회 구조의 상이함 등으로 그동안 기초 법체계의 이해에 많은 어려움과 혼란이 있었다. 최근 북한과 중국은 ‘법에 의한 통치’를 내세우면서 법률 정비 작업을 서두르고 있고 그 성과로 중국은 2000년 <입법법>을 제정하였고, 북한은 2012년 <법제정법>을 제정하고 2016년 ‘북한법전’을 공개하였다. 최근 북한과 중국의 일련의 입법체계 정비는 법률의 양적증가는 물론 법체계 측면에서도 상당히 구체화되어서 그동안의 불명확성과 모호성을 상당 부분 해소하고 있다. 특히 중국의 선제적 법체계 정비 작업은 북한의 입법과 법체계 변화의 모델이 되고 있다. 중국은 개혁개방으로 인한 산업화의 진전으로 입법 수요가 급증하였고 양적인 입법의 증가는 결과적으로 괄목할만한 질적 성장을 가져오고 있다. 북한 법체계의 바른 이해를 위하여 그 모델이 되고 있는 중국과의 비교분석 연구는 북한과 중국 법체계를 보다 정확하게 이해할 수 있는 시너지효과를 가져오는 작업으로 판단된다. 본 논문은 통일시대 법제통합의 관점에서 북한과 중국의 입법 현황과 법체계의 비교 고찰을 중심으로 고찰하였다. 남북한 사회의 핵심적 공유 가치를 가장 잘 확인할 수 있는 수단이 법 이라고 할 수 있으므로 상호 법률문화의 이해는 통합의 첫걸음이자 완성이라고 할 수 있다.

영문 초록

Legislative integration in a divided country is the unification of multiple legal systems that have been separated for a long time under different political and economic systems to each other. In this paper, the study was conducted to understand the peculiarities of the North Korean and Chinese legislative system from the perspective of the task of legislative integration in the unified Korea. The legal system of North Korea and China go through different development process to capitalist legislation based on the socialist legal system. In particular, there have been a lot of difficulties and confusion in understanding the basic legislation in the meantime due to the differences in ideological foundation of legislation, terminologies, and social structure, etc. Recently, North Korea and China have been rushing to reorganize their legislation promulgating ‘rule by law’ and as the outcome of it, China enacted in 2000, and North Korea enacted in 2012 to announce ‘North Korean Legislation’ in 2016. Recently, North Korean and Chinese reorganization of legislation has been considerably materialized in the quantitative increase of legislation but also in the legislation system; therefore it resolves a lot of the uncertainty and vagueness of the legislation system in the meantime. Recently, a series of reforms in particular, Chinese preemptive organization of the legal system has been a model of North Korean changes in legislation and legal system. In China, the demand for the legislation due to the industrialization progress through reform and open has been increased rapidly and the quantitative increase of legislation has resulted in noticeable qualitative growth. The research of comparative analysis with China, which has been a model for the proper understanding of North Korean legislation, is judged to be the task that brings the synergy effect to understand North Korean and Chinese legal systems more accurately. This paper contemplates focusing on the comparative study of the North Korean and Chinese legislative status and legal system from the perspective of legislative integration in the unification era. Since the best means to confirm the shared core values of South and North Korean societies can be ‘law’, understanding of mutual legal culture can be the first step and the completion of integration.
