국문 초록

북한 법정비지원 방안에서 가장 중요한 주체는 수원국인 북한의 법제 상황이다. 과거와 달리 수원국은 법제 수용 의지와 이행을 통해 주인의식⋅파트너십(Ownership and Partnership)을 갖고 행사하며, 자연스럽게 글로벌 스탠더드의 자유민주주의 질서에도 동참하는 것이 요청되어야 할 것이다. 법정비지원 사업 단위에서는 프로젝트별 형성과 법정비지원, 수행, 그리고 평가 모니터링 등에서 공여 주체인 대한민국과 협력하며 원조 일치를 구현하는 것이 지속적인 원조가 가능하다는 것을 북한도 이미 잘 알고 있는 사실이다. 따라서 본고는 북한 법정비지원 방안이 단순히 양적 평가 내지 질적 평가로 귀결될 수 있다고 결정짓기보다 외부적 환경 요소가 중요함을 강조하였다. 북한 법정비지원이 원활히 이루어지도록 하기 위해서는 유엔안보리 대북제재 이외에도 미국, 일본, EU 등의 협력도 필요하지만, 궁극적으로는 대한민국의 독자적인 법정비지원이 중요하고 체제전환국의 법정비 사례를 예시로 제시하였다. 법정비지원의 유형으로는 법정비지원을 위한 기술지원, 법제도 개혁, 외국인투자 법제 정비 등 법정비지원의 직⋅간접성의 대안 모색이 필요함을 강조하였다.

영문 초록

In the support measures for legal improvement of North Korea, the important subject is the legal situation of North Korea. Contrary to the past, a recipient country should be required to have and exercise the ownership and partnership through the will and fulfillment of accepting the legislation, and also to naturally participate in liberal democracy of the global standard. In the unit of legal improvement support project, North Korea already knows that the only way to receive the continuous assistance is to realize the agreement with assistance by cooperating with South Korea, the subject of provision, for the formation of each project, support for legal improvement, performance, and evaluation/monitoring. Thus, this thesis emphasized the importance of external environmental elements rather than deciding that the support measures for legal improvement of North Korea could be simply concluded by quantitative or qualitative evaluation. For the smooth support for legal improvement of North Korea, on top of the UN Security Council’s sanctions against North Korea, there should be some cooperations from the United States, Japan, and EU. Eventually, South Korea’s independent support for legal improvement is important, so the legal improvement case of transition country was presented as an example. As the types of legal improvement support, this study emphasized the necessity to seek for direct/indirect alternative to legal improvement support such as technical support for legal improvement support, reform of legal system, and improvement of foreign investment legislation.
