우버의 드론택시 표준모델을 수용한 헬리포트 관련 드론법 시행령 개정방안

국문 초록

국토교통부는 거점과 거점을 연결하는 최초 서비스를 2025년에 도입하고 도심 항공 모빌리티 선도국가로 도약한다는 한국형 도심항공교통(K-UAM, Urban Air Mobility) 로드맵을 제시하였다. 드론택시(UAM)를 실생활에 활용하기 위해서는 이 러한 변화된 환경에 능동적으로 대처할 수 있는 법과 제도가 필요하다. 현재는 드 론택시의 시험 운행을 위한 제도적 지원 등 하드웨어 차원의 검토만 하고 있을 뿐, 드론 택시가 상용화되면 승객들이 타고 내리는 승강장을 도입할 수 있는 근거법에 대해서는 논의가 이루어지지 않고 있다. 드론택시는 제4차 산업혁명 시대에 대표 적인 과학기술로 기존의 사람 중심의 항공 운행을 컴퓨터와 인공지능 중심의 드론 택시로 패러다임을 변화시키는 획기적인 기술임에도 불구하고 드론택시 승객의 door-to-door 서비스에 대한 법적, 제도적 인프라가 부족하여 상용화에 많은 어려움 이 예상된다. 본 연구는 우버가 제시한 드론택시 승객에 대한 door-to-door 서비스 를 수행하는 버티스톱(vertistop) 인프라에 대한 법적 쟁점을 검토하고자 하였다. 헬리포트는 화재 시 고층 건물 내부 사람들이 옥상으로 대피하면 헬기가 착륙하여 구조하거나 소방대원을 투입하기 위해 설치되는 중요한 설비이다. 본 연구는 현행 건축법에 명시된 헬리포트의 설치기준이 우버가 제시한 vertistop 기준을 충족할 수 있는지를 평가하였다. 현행 건축법상 헬리포트 기준은 우버에서 제시한 vertistop 표준규격을 충족하지 못하고 있다. 따라서 우버의 표준규격에 의거하여 제작되는 현대의 드론택시도 한국의 옥상에 설치된 헬리포트를 활용할 수 없는 상 황에 직면하고 있다. 따라서 본 연구에서는 vertistop 건축 및 인허가 준비에 대비 할 수 있도록 현행 드론 활용의 촉진 및 기반조성에 관한 법률 시행령에 드론택시 시범사업구역을 지정하는 개정안을 제시하여 드론택시(UAM)의 실증을 위한 승강 장(vertistop)으로 헬리포트를 활용할 수 있는 방안을 제안하였다. 드론택시 실증사 업을 수행하기 위하여 드론택시 시범사업구역만을 대상으로 헬리포트 면적을 완 화하는 법개정은 현행법 기준을 확대하는 것이어서 수범자의 혼란이 발생할 우려 도 적고 새로운 법을 처음부터 제정하는 것에 비해 입법 비용도 적을 것으로 판단 되어 현행법의 개정방안을 제시하였다.

영문 초록

The Ministry of Land, Infrastructure and Transport in South Korea proposed the K-UAM(Urban Air Mobility) roadmap to lead the world in UAM, by launching the first air taxi service in 2025. To introduce the drone taxi, related laws and regulations must actively cope with the rapidly growing technology. Currently, the government is conducting intensive discussions on drone taxi hardware, such as institutional support for test operation. No specific discussion has been made on how to introduce takeoff and landing spaces for passengers to get on and off when drone taxis are commercially operated. Drone taxi is a representative technology changing the paradigm from the existing human-centered aviation to artificial intelligence-oriented operation in the 4th industrial revolution era. However, difficulties will arise in the commercialization process, due to the lack of legal infrastructure for the door-to-door service of drone taxi passengers. This study was initiated to examine the legal issues on the vertistop infrastructure that Uber proposed to provide door-to-door service for drone taxi passengers. Heliport is an important facility installed in the rooftop of high-rise building, to save lives by sending the fire rescue worker to the rooftop in the event of a fire. This study evaluated whether the heliport size regulation specified in the current South Korean building law can meet the vertistop requirement proposed by Uber. The heliport specification specified in current building law does not satisfy the fundamental vertistop requirement set forth by Uber in terms of size. Therefore, even Hyundai air taxi to be manufactured according to Uber size requirements will be facing a situation where it cannot utilize the heliport installed on the rooftop of South Korea. Therefore, in this study, the legal basis for using the heliport as a vertistop for UAM was presented by proposing the drone taxi pilot project area in the national act to promote utilization and infrastructure of drones so that the government and industrial sector can quickly prepare for construction and licensing preparation on vertistop. There will be less legislative costs compared to enacting a new law from scratch and less resistance by building construction companies since this study proposed law amendment option to expand the heliport area specified in the current building regulation, targeting the drone taxi pilot project area alone.
