행정형 ADR의 활성화 방안에 관한 연구

국문 초록

현대 사회에 들어서면서 다양한 분야에서 전문화되고 복잡한 분쟁이 급증하고 있다. 이러한 분쟁을 법원의 소송을 통하여 해결할 수도 있지만, 소송으로는 분쟁당사자가 만족하는 방식으로 신속하게 분쟁을 해결하기에는 어려운 상황이다. 이에 따라 선진 외국뿐만 아니라 우리나라에서도 대체적 분쟁해결제도가 활용되고 있다. 우리나라에서는 대체적 분쟁해결제도의 유형으로서 행정형 ADR이 널리 활용되고 있는데, 행정형 ADR은 법원이나 민간이 아닌 행정기관이 직접 또는 산하기관 등을 통하여 분쟁을 해결하는 제도이다. 행정형 ADR은 소송과 비교하여 분쟁해결의 신속성, 분쟁당사자 사이의 관계 유지, 분쟁의 실질적인 해결 등의 측면에서 그 유용성을 가지고 있다. 더 나아가 행정형 ADR은 분쟁해결을 위한 사회적 비용의 낭비를 예방하고, 사회적 안정과 통합에 기여하는 역할도 수행한다. 따라서 행정형 ADR의 활성화 방안에 관한 연구를 수행할 필요성이 있다. 이 연구를 위해 우선 행정형 ADR의 개념과 의의, 행정형 ADR 기관의 현황과 분류에 관하여 살펴보았고, 행정형 조정위원회와 조정절차 등에 관한 사항으로서 조정위원회 위원(장)의 구성방식과 자격요건, 조정절차의 개시, 조정절차와 관련된 주요 사항, 조정성립의 법적 효력에 관하여 살펴보았다. 마지막으로 이 연구에서는 행정형 ADR의 활성화를 위한 개별 방안으로서 조정위원의 독립성과 중립성 및 전문성 확보, 조정의 비밀성 유지, 조정절차에서의 당사자의 적극적 참여 보장, 조정위원의 증원, 행정형 ADR의 홍보 강화, 조정에 대한 접근성 강화, 부분적 조정전치주의의 도입 등을 제시하였다.

영문 초록

As we enter modern society, specialized and complex disputes in various fields are increasing rapidly. These disputes can be resolved through court lawsuits, but it is difficult to resolve disputes quickly in a way that satisfies the parties to the dispute. Accordingly, not only in advanced foreign countries but also in Korea, alternative dispute resolution system is being used. In Korea, administrative ADR is widely used as a type of alternative dispute resolution system, and administrative ADR is a system in which administrative agencies other than courts or private sectors resolve disputes directly or through affiliated organizations. Administrative ADR has its usefulness in terms of promptness of dispute resolution, maintenance of relationships between the parties to the dispute, and practical resolution of disputes compared to litigation. Furthermore, administrative ADR prevents waste of social costs for dispute resolution and also plays a role in contributing to social stability and integration. Therefore, it is necessary to conduct research on how to invigorate administrative ADR. For this study, the concept and significance of administrative ADR and the current status and classification of administrative ADR agencies were first examined, and the composition and qualifications of the administrative mediation committee, initiation of mediation procedures, and legal effect of mediation. Lastly, as individual measures to invigorate administrative ADR, this study suggested securing the independence and neutrality of mediator and expertise of mediator, maintaining confidentiality of mediation, ensuring active participation of parties, strengthening access to mediation, and introducing of pre-litigation mediation principles.
