공무원 등 징계위원회의 구성과 관련한 소고

국문 초록

최근에 검찰총장에 대한 2개월 징계처분을 의결한 징계위원회 구성과 심의절차, 특히 기피의결에 대한 위원회 구성의 적법성 여부에 관하여 심도 있는 연구를 하고 있다. 검사징계법만이 아니라 공무원 등에 관한 징계 절차 규정을 거의 망라하여 검토하고 있다. 징계위원회 구성이 사전에 상시적으로 구성되어 있어야 하고, 특별한 징계사건을 앞두고 급작스럽게 구성되어서는 안된다. 특히 특정 사건의 징계청구 후 징계위원회의 위원을 구성하는 것은 바람직하고 않고, 징계위원회 구성의 중립성, 사전성, 상시성에 위배되어 위법하게 될 수도 있다. 징계위원 중 예비위원에 대한 지위와 역할, 징계위원 명단의 공개 등에 대하여도 심도있게 연구하고 있다. 또한 징계위원에 대한 기피신청에 대한 의결시 징계사건에 대한 심의와 의결 절차와 의사정족수, 의결정족수의 규정, 특히 검사징계법 제17조 4항의 ‘위원회는 기피신청이 있을 때 재적위원 과반수 출석과 출석위원 과반수 찬성으로 기피 여부를 의결한다. 기피신청을 받은 사람은 그 의결에 참여하지 못한다’는 규정을 어떻게 해석할 지도 폭넓게 검토하고 있다. 나아가 징계위원회 위원의 징계위원회 개최 이전에 사전 공개 여부에 관하여 사전 로비 방지, 위원의 독립성 보장, 징계의 공정성 보장을 위하여 공개금지가 원칙이라는 견해, 징계대상자의 방어권 보장, 공정성에 의심되는 위원에 대한 기피신청권 보장을 위하여 일반 대중이 아닌 징계대상자에 대하여는 사전 공개하여야 한다는 견해, 사전공개가 원칙이나 징계절차와 관련된 규정 중에 징계위원 기피에 대한 규정이 없다면 징계 대상자에게 징계위원에 대한 기피권이 있을 수 없으므로 사전 공개 의무가 없다는 견해와 징계위원 기피에 대한 규정이 없더라도 위원의 사전 공개 의무가 준수되어야 한다는 견해 등에 관하여 비교적 자세하게 검토하고 있다.

영문 초록

In-depth research is being conducted on the composition and deliberation procedures of the disciplinary committee that recently decided on a two-month disciplinary action against the prosecutor general, especially the legality of the committee s composition on the resolution. It is reviewing almost all disciplinary procedures regulations for public officials, as well as the Prosecutor s Disciplinary Act. The composition of the disciplinary committee must be organized on a regular basis in advance and should not be formed suddenly ahead of special disciplinary cases. In particular, it is not desirable to form a member of the disciplinary committee after requesting disciplinary action in a specific case, and it may be illegal because it violates the neutrality, permanency, and regularity of the disciplinary committee composition. It is also conducting in-depth research on the status and role of reserve members among disciplinary committee members and the disclosure of the list of disciplinary committee members. When deciding on an application for challenge against disciplinary committee members, the provisions of the disciplinary proceedings, quorum, and quorum apply as they are, especially in Article 17(4) of the Prosecutor s Disciplinary Act. Furthermore, whether the members of the disciplinary committee are disclosed before the disciplinary committee is held or not is being reviewed in relatively detail ; ① the opinion that prohibition of disclosure is a principle in order to prevent prior lobbying, guarantee the independence of disciplinary committee members, and guarantee the fairness of disciplinary action, ② a view that prior disclosure should be made to the subject of disciplinary action, not the general public, in order to guarantee the right of disciplinary suspect, guarantee to evade the disciplinary committee members suspected of fairness, ③ the opinion that prohibition of disclosure is a principle, if there is no provision on the evasion or refusal of disciplinary committee members suspected of fairness, ④ a view that prior disclosure should be made to the subject of disciplinary action, not the general public, even if there is no regulation on evasion of disciplinary committee members suspected of fairness.
