법원경매에서 임차인 보호를 위한 법제도 개선방안

국문 초록

법원경매제도 내에서 임차인의 법제도적 보호조치는 필요하다 임차인은 임대차 계약과정에서 공인중개사의 설명 또는 등기부등본 등의 확인을 통해 계약에서의 위험성 정도를 수차례 확인하고 계약한다 이러한 확인 작업을 통해 임차인이 인지하고 계약한 위험은 그 책임은 모두 계약자 본인에게 귀속된다 그러나 현행 법제도의 미비로 발생하는 예측 불가능한 문제로 발생하는 임차인의 재산상 손실은 개선되어야 한다. 법원경매제도에서 이러한 예측 불가능한 무과실임차인의 위험에 대해 그 위험을 제거하는 일은 사회적 약자인 임차인 보호뿐만 아니라 사회적 정의에도 부합하는 일이다 따라서 본 논문에서는 임차인의 과실이나 책임이 없는 법원경매에서 임차인의 위험에 대한 사례분석을 연구하였다 이를 통해 임차인 보호에 필요한 시급한 법제도적 정비의 시사점을 제시하였다.

영문 초록

In the court auction system, legal and institutional protection measures for lessees are necessary. The lessee confirms the degree of risk in the contract several times through the explanation of the real estate agent or the certified copy of the register during the rental contract process and concludes the contract. All risks recognized and contracted by the lessee through such verification work belong to the contractor. However, the loss of property of the lessee due to unpredictable problems caused by the lack of the current legal system should be improved. In the court auction system, removing the risk of such unpredictable no-fault tenants is in line with social justice as well as protection of the socially disadvantaged lessee. Therefore, in this paper, a case analysis was conducted on the risk of the lessee in a court auction where the lessee was not responsible or negligent. Through this, the implication of urgent legal and institutional reform necessary to protect tenants was presented.
