국문 초록

최근 테러의 공격양상은 계속해서 진화하고, 국내외 테러환경도 지속적으로 변화하고 있어. 테러정세변화에 따른 대테러 안전 확보는 항상 방심해서는 안 되는 현실적 안보 사항이다. 그중에서도 가장 우선적으로 검토되어야 하는 것은 테러방지법과 대테러활동과 관련한 각종 법령의 개선과 보완이다. 그것은 더욱 철저한 테러예방과 대응을 하기위해서는 무엇보다도 법률적측면의 검토가 필요하기 때문이다. 그러나 한국에 있어 법과제도, 대테러정책에 대한 발전적 논의는 여전히 미흡하다. 돌이켜보면 2016년 테러방지법 제정과 시행은 국민과 국가를 위한 안전과 안보적 측면에서 시의적절하고 성과적이라는 평가도 있지만, 제정과정에서 많은 우려와 논란이 제기 되기도 하였던 문제이기 때문에 법률의 완전성부분에서는 재검토와 보완이 요구되고 있다. 따라서 본 논문은 테러방지법 제정이후 나타나고 있는 테러정세 변화에 따른 대테러 관련법령의 개선방안을 연구·분석하기 위한 것이다. 이를 위해 테러와 테러방지법에 대한 이론적 논의, 최근 해외 대테러관계 법제의 동향, 테러방지법 시행이후 주요쟁점사항과 개정방안과 개선동향, 우리나라의 테러대응체계상 쟁점 및 개선방안 등의 순서로 분석·정리하였다. 특히 최근 테러정세 변화에 대응한 미국·영국·프랑스·독일의 대테러 관련법제의 동향분석을 통해 시사점을 도출하고, 국내 대테러 정책과 법령 및 관련규정의 벌칙규정, 대테러체계·조직(컨트롤타워), 정보수집활동, 대응절차 등과 관련한 테러방지법령의 조문개정 및 법제적 개선에 관한 발전적 방안을 제시하였다.

영문 초록

The reality is that while South Korea s legislation and implementation of the counter-terrorism Act in 2016 can be assessed as timely and fruitful, securing safety against terrorism should not always be vigilant. This paper is to study and analyze the improvement of counter-terrorism laws in accordance with the terrorist situation. To this end, this paper is composed of the theory of terrorism and counter-terrorism law; the recent trends in foreign counter-terrorism laws; major issues, revisions and improvement trends after the implementation of the counter-terrorism law in the ROK; issues and improvement in the ROK s terrorism response system; and conclusion. In particular, this paper draws implications through the trend analysis of the US, UK, France, and Germany s counter-terrorism laws in response to the recent terrorist changes, and suggests ways to improve domestic counter-terrorism policies, laws and regulations. The counter-terrorism law needs to be improved and supplemented in order to thoroughly prevent and respond to terrorism in the wake of the change in the state of terrorism. We will continue to work out measures to revise the provisions of the counter-terrorism act and improve legislation, including the definition of terrorist groups, the penal regulations, the counter-terrorism systems/organizations(control towers), the collection of information, and the response procedures, etc.
