국문 초록

상속인의 토지방치는 피상속인들의 상속채무가 많은 경우에 주로 발생한다. 이 경우 한정 승인을 하기보다는 상속채권자와 법률상 관계를 기피하여 상속포기를 선택하는 경향을 보인 다. 상속포기는 소유자불명 토지발생의 직접적인 원인이 되고 있으며, 소유자불명 토지는 상속포기의 의사표시, 상속인의 부존재, 상속인의 존재가 분명하지 않는 경우에 발생하게 된다. 이러한 배경하에 이 연구는 소유자불명으로 인해 발생하는 토지의 법률적 문제를 해결하기 위한 대안으로 상속인의 상속재산관리제도에 대한 개선방안을 다음과 같이 제안한다. 첫째, 상속인의 상속재산 관리의무 범위를 선관주의의무로 강화해야 한다. 둘째, 상속인이 상속재산 관리의무를 다하지 못할 경우를 대비하여 국가, 지방자치단체 등에서 반드시 상속재산을 관리할 전담인력을 운용해야 한다. 셋째, 상속인 부존재의 경우 반드시 공정하고 전문성을 가진 상속재산 관리인을 선임할수 있는 제도적인 개선이 요구된다.

영문 초록

The inheritor s land value mainly occurs when the inheritors have a large inheritance obligation. In this case, rather than giving limited approval, there is a tendency to choose to abandon inheritance by avoiding legal relations with the inheritance creditor. Abandonment of inheritance is a direct cause of the occurrence of land of unknown owner, and land of unknown owner occurs when the expression of intention to renounce inheritance, the absence of an heir, and the existence of an heir are not clear. Against this background, this study proposes the following improvement measures for the inheritor s inherited property management system as an alternative to solving the legal problems of land arising from unknown owners. First, it is necessary to strengthen the scope of the heir s obligation to manage inherited property with a necessity. Second, in case the heir fails to fulfill the obligation to manage the inherited property, the state, local governments, etc. must operate a dedicated manpower to manage the inherited property. Third, in the absence of an heir, institutional improvement is required to appoint a manager of inherited property with fairness and expertise.
