구분소유자의 임시관리단집회에 관한 고찰

국문 초록

개정 ｢집합건물법｣은 구｢집합건물법｣이 구분소유자에 의한 임시관리단집회 소집 요건에 대하여 구분소유자의 5분의 1이상으로서 의결권의 5분의 1이상으로 한 것을 구분소유자의 5분의 1 이상으로 완화하고, 집회소집권자를 관리인이 소집통지절차를 밟지 아니하는 경우 소집을 청구한 구분소유자는 관리단집회를 소집할 수 있도록 한 것을 그 소집을 청구한 구분소유자가 법원의 허가를 받아 소집할 수 있도록 하는 한편, 그 집회소집 및 결의요건을 결한 결의에 대한 취소권을 명문화한다. 이와 같은 개정법의 취지는 구분소유자의 임시관리단집회소집을 현실화하고, 요건을 결한 결의의 다툼을 최소화하려는 의도로 파악된다. 그렇다면, 개정법의 취지는 집합건물의 관리현실과 부합하는 것인가 문제된다. 본고에서는 개정법상 구분소유자의 임시집회소집청구권 및 집회소집권의 요건을 분석하고 그 문제점을 제시함으로써 관리사무집행에 원활과 입법에 참조토록 하였다.

영문 초록

Amendment 「Aggregate Buildings Law」, relaxes for the convening requirements, in more than one-fifth of division owner, of the extraordinary convocation of management association. And previously, if the manager does not fulfill the convocation notification procedure, although division owner who claims the convocation was so that it may convene a convocation of management association by his request, but as the revised law, he may convene it with the permission of the court. Also is documented the right of rescission of determination lacking the convocation and determination requirements. These, purpose of revised law is to realize the convocation right of a extraordinary convocation of management association of division owner, and to minimize the conflict, caused by determination lacking requirements. If so, does the intent of the amendment is consistent with the management reality. In this paper, we analyze convened claims of a extraordinary convocation of management association of division owner and it’s requirements on the amended law, to complement their problems.
