국문 초록

본 연구의 목적은 토지소유권의 개념과 토지소유권의 범위를 고찰하고, 토지소유권의 입체적 범위에 대한 학설과 판례를 검토한 후, 토지소유권의 효력범위와 입체적 범위를 한정해보는 것이었다. 연구 결과, 토지소유권의 절대적 범위는 1차적으로 인간이 호흡 가능한 범위까지를 토지소유권의 절대적 범위로 보았다. 따라서 본 연구를 통해 ‘호흡가능 범위설’을 제안하였다. 2차적으로는 토지소유권자의 지상공간과 지하공간에 대한 권리관계가 공적장부를 통해 공시되고 있는 범위까지로 한정하였다. 토지소유권의 상대적 범위는 절대적 범위를 제외하는 영역에 대한 상하범위로 볼 수 있으며, 민법과 같은 사법적 영역에서가 아닌, 공법적 영역에서 토지공개념의 원칙에 따라 개별법 특히, 일필지에 대한 근거법인 공간정보의 구축 및 관리 등에 관한 법률을 중심으로 건축법, 국토의 계획 및 이용에 관한 법률, 토지이용규제 기본법 등을 통해 그 상하범위를 한정함이 보다 바람직할 것으로 판단하였다.

영문 초록

The objective of this study was to limit the effect range and three dimensional scope of land ownership by evaluating the concept and scope of land ownership and reviewing the theories and precedents on the three dimensional scope of land ownership. The results of this study showed that the absolute scope of land ownership was primarily regarded as the extent that people could breathe. Therefore, this study proposed the respirable range theory . Secondly, the rights of the land ownership for the aboveground space and belowground space were limited to the scope disclosed in the public ledger. It was found that the relative scope of land ownership could be viewed as the upper and lower scope of the area excluding the absolute scope. It was determined that it would be more preferable to limit the upper and lower ranges through the Building Act, the National Land Planning and Utilization Act, and the Framework Act on the Regulation of Land Use, while focusing on individual laws, particularly the Act on Establishment, Management, Etc. of Spatial Data, which is the applicable law of a parcel, according to the principle of the public concept of land ownership in the public legal domain, not in the private legal domain such as the Civil Act.
