독도 문제에 관한 제3국 학자의 연구 동향

국문 초록

한국은 독도를 양국 간의 외교 교섭의 대상으로도, 제3자에 의한 분쟁해결의 대상으로도 인정하지 않지만 일본은 독도에 대한 영유권 주장을 포기하지 않고 있다. 독도 문제를 국제적인 법정에 강제적으로 제소할 수 있는 방법이 없는 일본으로서는 국제 사회의 여론을 독도 문제에 관한 가상 법정처럼 생각할 수도 있다. 최근 일본의 영토 문제와 관련하여 “국제적으로 영향력·발신력이 있는 제3국에서 일본 입장에 대한 지지를 얻어야 한다”고 하면서 영토 문제에 대한 일본의 입장을 영어로 전달하는 정보 발신의 중요성을 강조하고 있는 일본 정부의 움직임은 이런 맥락에서 이해할 수 있다. 이런 상황 속에서 한국과 일본 두 나라의 학자가 아닌 제3국 학자의 독도 관련 연구 동향을 살펴보는 것은 독도에 관한 국제사회의 여론 동향을 파악할 수 있다는 점에서 의미가 있다. 독도 문제에 관한 법적 연구에 한정하여 보면 제3국 학자의 연구는 시기적으로는 1990년대 이전에는 보기가 어렵다. 1990년 말에 영어로 된 제3국인의 독도 연구 논문이 등장하여 2000년대에 그 수는 늘어났다. 그러나 2010년 대에 들어 가장 많은 논문이 발표되고 있다. 제3국 학자들의 독도 영유권에 관한 논고들은 거의가 독도에 관하여 한국이 일본보다 우월한 법적 영유근거를 가지는 것으로 결론을 내리고 있다. 그리고 한국이 일본의 독도 문제 제소 주장을 받아들이라고 권고하는 것이 많다. 이들 제3국 학자들의 독도 연구에는 한국 학자가 영어로 제공하는 지식과 정보가 큰 영향을 미치고 있다. 제3국 학자의 독도 연구 논고들은 일종의 가상의 법정과 같은 역할을 하여 독도에 관한 한국과 일본의 국내 여론에도 영향을 미칠 수 있다. 독도 문제에 관해서는 제3국 학자와 국민과 같이 객관적인 입장에 있는 사람들을 설득하고 자국의 주장에 동의하도록 하는 합리적이고 균형 잡힌 시각과 논리가 필요하다.

영문 초록

Even though Japan sedulously argues that there exists a dispute surrounding Dokdo and have proposed the bringing the issue before the ICJ to the Korean government for 3 times, Korea does not recognizes Japanese argument and has no intent to accept the Japanese proposal. In this circumstances, Japan may be attracted to the thought considering international public opinion with regard to Dokdo like a kind of imaginary judicial court. The recent Japanese government s emphasis on international communication concerning the Dokdo issue may be understood in this context. In this sense, having a review of studies of Dokdo issue by third party scholars may be helpful in comprehending current international public opinions regarding the Dokdo issue. When focus is narrowed only on the legal studies of Dokdo issue by third party scholars, it is hard to find out such studies before 1990s. The first study of legal problem concerning the territorial sovereignty over Dokdo came out only later 1990s. However, the numbers of such studies began to increase in 2000s and such tendency became strong in 2010s. Most third party scholars studies of Dokdo issue conclude that Korea has superior legal claim over Dokdo to Japan. On the basis of such conclusion, may third party scholars recommend Korea s agreement to referring the Dokdo issue to the ICJ. When it comes to the problem how the third party scholars who carried out studies on the territorial sovereignty over Dokdo got knowledges and information about Dokdo issue, it may be said that Korean scholars articles written in English exerted much influence. When Korea wants to let international public opinion apprehend its position and argument about the Dokdo issue, communication by English seems to be mostly crucial. In addition, such position and argument must be reasonable one having persuasive power for the third party scholars and people.
