국문 초록

현행 법전 제50조는 집행권자에게 개별 교령을 발령하기 전에 당사자의 방어권을 보장하기 위한 엄격한 준비 과정을 밟아야 한다고 강조한다. 교구 직권자는 교회의 통치권 중집행권을 행사하면서 올바른 행정 행위를 발령해야 할 의무가 있으며, 자신의 행위로 불합리한 피해자가 발생하지 않도록 주의를 기울여야 할 책임이 있다. 현행 법전은 이러한주의를 당부하면서도 자세한 행정 절차를 규정하지는 않는다. 본 논문은 다양한 개별 행정 행위들 중 개별 교구의 교구 직권자가 발령하는 개별 교령에 관해 집중적으로 다룬다. 개별 교령은 개별 행정 행위 중에 교구 직권자가 가장 폭넓게 활용하는 행정 행위로, 어떤 분쟁이나 문제를 해결하기 위한 판정이나 조치를 담고 있다. 교구 직권자가 개별 교령의 발령 절차를 시작하는 시점은, 자신의 개입이 필요한 사건이나 사안에 관해 인지하게될 때이다. 사건의 구체적 조사가 필요하다는 판단이 서면, 교구 직권자는 직접 혹은 다른 이를 통해서 증거와 정보를 수집하고, 권리를 침해당할 수 있는 사람들의 의견을 들어야 한다. 이를 통해 교구 직권자는 사건의 실체적 진실에 접근할 수 있고, 개별 교령 발령의 적합성이나 필요성을 정확히 판단할 수 있으며, 당사자에 대한 올바른 존중과 배려를 할 수 있다.

영문 초록

Canon 50 of the current code insists that precise preparation procedures must be taken to ensure the right of defenses of parties before issuing the singular decrees to persons possessing executive power. The local ordinary has an obligation to issue proper administrative acts while exercising the executive power of the ecclesiastical power of governance and has responsibility for taking special care not to cause any unreasonable victims of his conduct. The current code does not stipulate detailed administrative procedures, even though advised to take these precautions. This paper focuses on the singular decrees issued by the local ordinary of individual dioceses among various singular administrative acts. The singular decree is the most vastly utilized singular administrative act by the local ordinary that contains decisions or measures to resolve certain conflicts or problems. The local ordinary initiates the procedure for issuing a singular decree when he recognizes an event or issue that requires his intervention. When a decision is made upon the necessity of detailed examination, the local ordinary should directly or indirectly collect proof and information and consult those whose rights could be harmed. Throughout this, the local ordinary could access the substantial truth of the case, accurately determine the compatibility or necessity for publication of singular decrees and provide sufficient respect and solicitude for the parties.
