실종장애인 사건 수색을 위한 제도개선방안연구

국문 초록

장애인 실종사건은 18세미만 아동, 치매환자와 함께「실종아동 등의 보호 및 지원에 관한 법률(약칭: 실종아동법)」에서 규정하고 있다.「실종아동법」은 실종사건 발생의 예방 및 수색과 관련된 종합적인 사항을 단행법으로 규정하고 있는 법률이라는 점에서 그 의미는 상당하다 할 것이나, 문제는 이러한 포괄적인 법제 방향이 발달장애인과 같이 상황적·유형적 특수성이 고려되어야 하는 경우 그 수색에 있어 실효성 있는 제도로서의 역할을 다하지 못하고 있다는 점이다. 현재 실종사건 발생 시 장애인의 경우 장기미제사건 또는 최악의 결과라고 할 수 있는 실종자가 사망한 채로 발견되는 비율이 유독 상대적으로 높게 나타나고 있다. 가장 큰 원인은 장애인실종사건에 대한 전문대응매뉴얼과 전담기관의 부재에 있다. 18세미만 아동, 치매환자들의 경우 별도의 실종사건전담기관이 설립·운영되고 있는 것과 달리, 장애인은 18세미만 아동을 전담하는 아동권리보장원이 실종사건 발생 시 장애인과 18세미만 아동을 함께 전담하고 있다. 그렇다 보니 발달장애인과 같은 행동적 특수성이 고려되어야 하는 경우 수색의 전문성은 그 과정에서 담보되기 어려울 뿐만 아니라 예방 및 장기화되는 수색 과정에서의 행정규칙, 조례 등 제도적·정책적·종합적 접근에 있어서도 이러한 전담기관의 부재는 분명한 한계로 작용하고 있다. 따라서 본 연구에서는 장애인 실종사건 발생 시 수색과정에서 현장 활용도를 증대시키기 위해 장애인 실종사건의 특수성이 반영된 ‘독립적인 전담기관’ 설립 및 ‘전문대응매뉴얼’ 구축의 필요성과 관련법제의 제·개정을 통해 장애인 거주시설 입소 전 무연고 여부를 시설을 관리 ·감독하는 지방자치단체에서 의무적으로 판단하도록 하는 내용을 핵심으로 하는 ‘사전심사제도’의 신설을 제도개선방안으로 제시하고 있다.

영문 초록

The disappearance of the disabled are stipulated in the 「Act on the Protection and Support of Missing Children, etc. (abbreviated as: Missing Children Act)」 together with children under the age of 18 and dementia patients. Its meaning is significant in that it is a law that stipulates comprehensive matters related to the subject matter as a single law. The point is that it is not fulfilling its role as an existing system. Currently, in the case of a the disappearance of the disabled, the ratio of missing persons found dead and a long-term unsolved case is relatively high. The biggest cause is the absence of a necessary manuals and a separate department responsible for the disappearance of the disabled. In the case of children under the age of 18 and dementia patients, a separate government agency is established and operated. But for the disabled, when a missing person occurs, the National Center for the Rights of the Child, which is responsible for children under the age of 18, is in charge of those cases and children under the age of 18 together. As a result, when behavioral peculiarities such as those with developmental disabilities must be considered, the professionalism of the search cannot be guaranteed in the process. This is because the absence of a separate agency can be bound to be acted as a limitation. In this study, in order to increase the use of the field in the search process in case of disappearance of the disabled, is proposing the necessity of establishing an independent agency reflecting the specificity of the disappearance of the disabled. Plus the establishment of a preliminary screening system, which mainly requires that local governments that manage and supervise the facility to determine whether or not there is any affiliation before entering a residential facility, is proposed as a system improvement plan.
