국문 초록

소위 외국연예인 비자로 불리우는 예술흥행비자(E-6)를 도입하여 현재까지 운영하고 있는 우리나라에서는 최근까지도 E-6사증 본래의 목적을 벗어난 다양한 인권침해 사례가 언론을 통하여 자주 보도되고 있다. 정부에서도 이와 같은 불법적인 상황을 이미 오래 전부터 인식하고 있었고 2000년 이후 다양한 대책을 제시하고 있지만, 상황의 호전은 좀처럼 되지 않고 있는 것이 현실이다. 특히 호텔·유흥비자(E-6-2) 체류자격 외국인여성 가운데 일부 종사자들이 사증에서 허용하고 있는 공연보다는 외국인전용유흥음식점 등에서 유흥접객원으로 일하거나 성매매를 강요받다가 불법체류자로 전락하여 자의반 타의반으로 본국으로 추방당하는 사례가 가장 심각한 인권침해의 유형으로 분석되는데, 위와 같은 상황에 대한 범정부 차원의 대책마련이 시급하다고 할 수 있다. 지금까지의 다양한 행정조치의 개선도 외국연예인의 인권침해를 예방하고 방지하는데 어느 정도 기여하겠지만, 보다 본질적인 쟁점이 되어야 하는 것은E-6비자의 문제를 비단 기존의 논의와 같이 외국인여성에 대한 인권침해 또는 외국인여성에 의한 성매매의 문제로 접근하기 보다는 인신매매의 문제로 접근하여 다각적인 방면에서의 예방 및 대처방안을 마련하는 것이라고 생각한다. 본고는 이와 같은 기본적인 관점을 바탕으로 예술흥행비자 운영의 변천과정, 최근의 예술흥행비자제도 운영실태, 호텔·유흥비자 소지 외국인 여성의 인신매매 과정 분석, 현행법 적용의 한계상황 등을 살펴본 다음 성매매 목적의 인신매매 및 성매매피해자의 적극 인정, 정립된인신매매개념을 통한 인신매매등범죄피해자의 적극 인정, 인신매매 피해자 식별의 적극적인 확인 등의 입법적·정책적 대응방안을 제시하기로 한다.

영문 초록

In Korea, which has introduced an art entertainment visa (E-6) called a so-called foreign entertainer visa, until now, various cases of human rights violations that have escaped the original purpose of E-6 certificate have been frequently reported through the media. The government has already recognized such illegal situations for a long time and has been offering various measures since 2000, but the situation is not improving. Especially, some of the foreign women who are qualified to stay in hotels and entertainment visas (E-6-2) are considered to be the most serious types of human rights violations, such as the cases where some of the foreign women are forced to work as entertainment guests at foreign-only entertainment restaurants or to be forced to engage in prostitution. The improvement of various administrative measures so far will contribute to preventing and preventing human rights violations of foreign entertainers, but the more essential issue is to prepare preventive and coping measures in various aspects by approaching the issue of human rights violations or prostitution by foreign women rather than approaching the issue of E-6 visas as a problem of human rights violations or prostitution by foreign women. In other words, it is necessary to change the way of approaching the human rights violations of foreign women with hotel and entertainment visa (E-6-2) from the perspective of prostitution. Based on this basic perspective, this study examined the process of changing the operation of art entertainment visas, the current state of operating the art entertainment visa system, the analysis of human trafficking process of foreign women with hotels and entertainment visas, the limitation of applying the current law, and then examined the active recognition of human trafficking and prostitution victims for prostitution purposes, active recognition of victims of human trafficking and other crimes through established concept of human trafficking, the revision of the performance law, and the active confirmation of identification of human trafficking victims. The legislative and policy countermeasures will be presented.
