온라인 그루밍 처벌규정의 도입 의의와 과제

국문 초록

디지털 기술의 발달 및 스마트폰의 보급이 확산되어 있는 오늘날, 아동·청소년을대상으로 하는 디지털 성범죄는 정보와 기술을 바탕으로 보다 은밀하게 확대되고 있다. 온라인을 기반으로 한 아동·청소년 성착취 및 온라인 그루밍에 대한 문제가 지속적으로 제기됨에 따라 2021년 아동·청소년의 성보호에 관한 법률이 개정되면서 ‘온라인 그루밍’에 대한 처벌 규정을 마련하게 되었다. 그루밍 관련 판결의 검토를 통해본 바와 같이, 종래 판례 보다 미성년 대상 성범죄에 있어서 아동·청소년 대상 성범죄내지 그루밍에 의한 성폭력의 특성을 고려한 적극적 해석 및 법리 구성이 이루어진것으로 평가할 수 있다. 그러나 여전히 그루밍 행위 자체에 대한 처벌로는 미흡하며, 법리 해석의 어려움과 일부 포섭되지 않는 해석의 한계를 극복할 수는 없다. 청소년성보호법 개정을 통해 온라인 그루밍 처벌규정을 마련하게 됨에 따라 온라인 그루밍행태를 선제적으로 제재하여 심각한 성범죄 피해발생을 예방할 수 있을 것으로 기대한다. 온라인 그루밍 처벌규정의 도입에 의의를 두는데 그치지 않고 실효적인 처벌을 위해서는, 온라인 그루밍행위에 한정하는 것이 아니라 ‘그루밍행위’에 대한 처벌규정이 마련되어야 할 것이며, 성적 착취의 목적을 어떻게 해석할 것인지에 대한 기준이 필요하다. 그루밍의 처벌과 성범죄에 대한 예비·음모죄와의 관계 및 구별에 대해서도 향후 논의가 필요하다

영문 초록

Today, with the development of digital technology and the spread of smartphones, digital sex crimes targeting children and youth are expanding more covertly based on information and technology. Accordingly, as the issue of online-based sexual exploitation of children and youth and online grooming continued to arise, Act on the Protection of children and youth against sex offenses in 2021 was amended to provide penalties for ‘online grooming’. As seen through the review of precedents related to grooming, it can be evaluated that, rather than prior precedents, an active interpretation and legal constitution were made in consideration of the characteristics of sexual violence against children and youth or sexual violence caused by grooming in sex crimes against minors. However, it is still insufficient as punishment for the act of grooming itself, and the difficulty of interpreting legal principles and limitations of interpretation that are not partially covered cannot be overcome. As online grooming punishment regulations are prepared through the revision of the Youth Sexual Protection Act, it is expected that serious sexual crimes will be prevented by preemptively sanctioning online grooming behavior. In order not only to introduce the online grooming punishment regulations, but also to provide effective punishment, punishment regulations for ‘grooming behavior’ should be prepared rather than limited to online grooming behavior. And we need a standard for how to interpret the purpose of sexual exploitation. Future discussions are also needed on the relationship and distinction between the punishment of grooming and the crimes of preparatory and conspiracy for sex crimes.
