OSCE의 군사적 신뢰구축조치(CSBM) 검토

국문 초록

본고는 2018년 한반도 정세가 진전됨에 따라, 한반도에서 군사 분야 신뢰구축 필요성에 대한 논의가 점증하고 있는 상황에 주목하였다. 특히 군사적 신뢰구축은 우리정부 목표인 평화체제 구축의 중요 요소이기도 하다는 점에서 보다 정책적 차원에서 해당 문제에 접근할 필요가 있다. 이와 관련, 본고는 오늘날 군사적 신뢰구축조치를 비교적 안정적으로 실시하고 있는 것으로 평가되는 OSCE에 주목, OSCE의 관련 대표적 조치라고 할 수 있는 ‘비엔나 문서’와 ‘행동 규범’ 문서의 내용 및 실행 메커니즘을 살펴보았다. 또한 OSCE가 어떠한 조직과 협의체를 통해 신뢰구축조치를 실행하고 있는지도 검토해보았다. 검토 결과, 비엔나 문서에 기초, OSCE 한 회원국의 특정 군사행동에 대해 타회원국들이 제한적인 사찰(inspection)을 연례적으로 실시하는 등 OSCE 역내에서는 현장의 신뢰구축조치가 실시되고 있음을 알 수 있었다. 또한 OSCE 행동규범 문서는 무력의 민주적 통제와 같은 국가내(intra-state) 차원의 다양한 원칙을 제공하고 있다. 또한 OSCE는 양 문서에 대한 회원국 이행 상황을 연단위로 평가하는 정기 메커니즘도 구비하고 있다. 이러한 OSCE의 군사적 신뢰구축조치는 회원국간 상설 협의체인 안보협력포럼(FSC)과 사무국 갈등방지센터(CPC) 주관으로 실행되고 협의되고 있다. OSCE의 군사적 신뢰구축조치 실행 사례는 관련 조치를 반복적으로 실행하는 것이 중요하며, 또한 군사적 신뢰구축조치도 군사분야와 직접 관련된 부분을 넘어 폭넓게 접근할 수도 있다는 것을 보여준다. 또한 신뢰구축조치에 대한 정기적 평가 메커니즘의 유효성에도 주목할 필요가 있다는 함의를 준다.

영문 초록

The motive of this article comes from the recent progress of the North-South Korean relations, which opens the possibility to discuss confidence and security building measures(CSBMs) over the Korean Peninsula. Against this background, this article focuses on the Organisation for Security and Cooperation in Europe(OSCE) which has implemented CSBMs in a consistent manner. In particular, this article studies the “Vienna Document” and the “Code of Conduct” of the OSCE, as of the representative CSBMs of this organisation. In addition, this article examines the consultation mechanism and secretariat of the OSCE responsible for the implementation and review of the CSBMs within the OSCE region. The review demonstrates that the participating states conduct the CSBMs in the field such as mutual inspections on the notifiable activities in the specified area, as of the established practices based on “Vienna Document”. “Code of Conduct” is a comparatively normative document and provides a series of principles related to intra-state matters such as democratic control of the armed forces. The implementation of the two documents are also reinforced by annual review mechanism for examining the implementation level of each participating states. In addition, Forum for Security Cooperation(FSC), a regular consultation mechanism among the participating states, and Conflict Prevention Centre(CPC) of the OSCE secretariat are the main organs to plan and discuss the CSBMs within the OSCE. The study of the OSCE’s implementation of the CSBM gives implications to design and plan effective and sustainable CSBMs over the Korean Peninsula.
