유럽연합 기본권 헌장의 의의와 한계

국문 초록

유럽연합은 ‘유럽연합 기본권 헌장(Charter of Fundamental Rights of the European Union)’의 정립을 통해 ‘인권 존중’이라는 공동 가치를 바탕으로 ‘하나의 유럽’을 지향해 왔다. 기본권 헌장은 유럽연합에서 보호해야 할 기본권을 단일한 문서로 종합하였다. 2009년 리스본 조약 이후 기본권 헌장은 법적 구속력을 가진 문서가 되었으며, 유럽연합과 그 회원국들은 소수민족을 포함한 유럽연합 시민들과 유럽연합에 거주하거나 혹은 체류하는 사람들의 기본권을 존중해야 할 의무를 갖게 되었다. 그럼에도 불구하고 사회경제적 권리와 관련된 기본권은 회원국의 자율적인 판단에 맡겨짐에 따라 소수민족들이 자신들의 기본권을 제대로 보장받지 못하고 있다. 특히 유럽연합 내 가장 큰 소수민족인 로마족(Roma)은 기본권을 제대로 보장받지 못하는 극심한 배제와 차별의 희생양 가운데 하나이다. 본 논문은 기본권 헌장의 기원과 발전과정을 역사적으로 살펴보고 기본권 헌장의 법적 지위와 그 내용을 고찰하고자 한다. 더 나아가 본 논문은 로마족의 사례를 들어 유럽연합과 회원국의 ‘공동책임’ 하에서 소수민족의 권리 보장에서 나타나는 기본권 헌장의 한계에 대해 지적하고자 한다.

영문 초록

The European Union has oriented ‘one Europe’ based on the common value of ‘respect for the human rights’ through the establishment of ‘Charter of Fundamental Rights of the European Union’. The Charter brings together in a single document the fundamental rights protected in the EU. After the Treaty of Lisbon in 2009, the Charter becomes a legally binding document. Under the Charter, the European Union and its Member States have to comply with respect for the fundamental rights of any citizen of the European Union including national minority and any person residing or having its registered office in a Member State. Nevertheless, the national minority does not guarantee their fundamental rights for the part of social-economic rights at the discretion of the Member States. Especially, the Roma – Europe’s largest national minority - is one of the victims of the discrimination and social exclusion without the guaranteeing of the Fundamental rights. This article examines the historical overview and the contents with the legal statues of the Charter. Furthermore, it will be indicated the limit of the Charter in guaranteeing the fundamental rights of national minority within the ‘Joint Responsibility’ of the European Union and its member states with the case of the Roma.
