국문 초록

과거 저작권 침해와 오늘날의 저작권 침해를 비교해보면 오늘날은 디지털 기기 및 환경과 관련되어 있다. 더욱이 빠르게 변화하는 컴퓨터와 네트워크 환경에 따라 저작권 침해의 양상도 변화하기 시작했다.한·미 FTA와 관련된 저작권법 개정으로 저작권법 제2조 제22호에서는 컴퓨터나 네트워크의 일시적 저장도 복제의 범주라고 규정하였다. 미국 등의 다른 나라에서도 이미 컴퓨터나 네트워크 사용과정에서의 부수적이고 기술적으로 일어나는 일시적 저장을 복제에 포함하였다. 그 후 일련의 저작권법 개정으로 일정한 경우 일시적 저장을 허용하였다. 이러한 일시적 저장이 허용되는 경우는 일상적으로 기술에 수반하여 발생하는 일시적 저장, 복제기기의 보수와 수리를 위한 일시적 저장, 비영리 목적을 위한 일시적 저장 등이다. 이렇게 허용되는 이유는 저작물 이용과정에서의 일시적 저장은 모두 침해적인 것으로 볼 수 없으며, 저작권자의 권리를 침해할 가능성이 없거나 저작물의 물질적 가치에 손실을 입힐 우려가 없는 경우에는 저작물의 침해의 예외로서 인정해야하기 때문이다. 앞으로 디지털 기기와 디지털 프로그램의 공정한 이용을 위해서는 기존 여러 나라의 규정이나 판례를 살펴보는 것도 중요하지만 더욱 필요한 것은 저작권자와 프로그램 이용자 간의 공정한 이용에 대한 인식 공유와 프로그램 이용자들의 디지털 기술 환경에 부합하는 판단기준과 디지털 기기의 공정한 이용 경험을 가지는 것이 중요하다.

영문 초록

Due to the revision of the copyright law related to the Korea-US FTA, Article 2 No. 22 of the Copyright Act stipulates that temporary copying of items on personal computers or networks is also a category of reproduction. Other countries, such as the United States, have already included temporary copying in the process of using computers or networks as ancillary and a technical temporary copy. Subsequently, a series of revisions to the copyright law allowed temporary copying in certain cases. When such temporary copy is allowed, it is temporary copy that occurs with technology on a daily basis, for maintenance and repair of duplicate equipment, and for non-profit purposes. The reason for these permission is that all temporary copying in the process of using a work cannot be regarded as infringing, and if there is no possibility of infringement of the rights of the copyright holder or loss of the material value of the work, it is stipulated as an exception to the infringement of the work. For the fair use of digital devices and digital programs in the future, it is important to review existing regulations and precedents, but what is more necessary is the sharing of awareness of fair use between copyright holders and program users, and criteria that meets the digital technology environment of program users.
