국문 초록

우리사회가 지식정보화시대로 빠르게 진입하면서, 보다 편리한 생활에 목표를 둔 기술 개발과 그에 따른 상업성은 스마트폰 가입자 2천만 시대라는 사회로 발전하였다. 인터넷이 상용화되고 발달함에 따라 스마트폰 대중화 시대에 야기된 문제는 사용자들의 개인정보가 무분별하게 유통되고 있고, 그로 인해 부정한 목적으로 이용되는 부작용이 나타나고 있는 실정이며, 이를 제재시키는 방향을 모색하기 위해 개인정보보호법이 제정･공포 되어 시행되고 있다. 이러한 우리 사회의 변화에 있어서 사용자들의 개인 정보의 유출로 인한 피해에 대하여 보호받을 수 있고 또 그 피해를 구제 받을 수 있도록 마련된 제도적 장치로서 제정된 개인정보보호법의 역할이 무엇인지와 그 올바른 방향에 대하여 알아보고자 한다. 헌법상 보장되어 있는 개인정보자기결정권을 보호하기 위한 노력으로 국민 개개인 스스로 개인정보자기결정권에 대한 인식과 자신의 정보를 관리･결정･통제하려는 주인의식을 가져야 하며 정보의 주체와 정보의 보유자를 위한 올바른 윤리의식과 법의식이 필요함과 동시에 국가와 사회기관들의 올바른 법인식과 윤리교육을 통하여 개인정보보호 의식을 고취시켜야할 책무가 있다. 막대한 정보의 교류와 소통이 이루어지고 있는 지금의 지식정보화사회에서 이러한 개인정보에 대한 사회적 인식의 확대와 노력은 지식정보사회의 선진국이 되는 과정이라는 인식과 함께 법을 제정비하고 대처해 나가야 할 것이다.

영문 초록

As our society is entering rapidly an era of knowledge and information, The technical development aimed at a more convenient life and its commercial has evolved age of 20 million smartphone subscribers. As the internet is becoming commercial and development, the issues that raised in the era of smartphone popular is indiscriminate distribution of users’s personal information and side-effects have been suggested for using fraudulent purposes. So to find a way to restrict this, the Privacy Act has been enacted and announced. These changes in our society, it is recognize to the role of the Privacy Act and its in the right direction for users. An effort of protection for Personal information self-determination guaranted in the Constitution, Citizens are must have a sense of ownership for management, decisions and control their personal information and recognition of Personal information self-determination. Correct ethics and recognition of law are need for main agent and holders of information. besides national and social institutions are responsible for protecting personal information by through the correct ethics education and legal recognition. In today’s Knowledge and Information society that made exchange and communication of enormous information. Expand and effort of social awareness about this personal Information, we have to reorganize the law with recognition that the process of Knowledge and Information society’s advanced country.
