국문 초록

오늘날 개인정보의 유출 문제가 점점 심각한 문제로 등장하고 있다. 2011년 개인정보보호법이 시행 되었지만, 오히려 더 복잡해진 개인정보보호법제, 법원의 피해자 구제에 대한 소극적인 태도, 기업의 개인정보에 대한 소홀한 관행 등이 IT정보화의 후폭풍으로 국민들의 불안을 키우고 있다. 소셜 네트워크 서비스 이용자는 자신의 사회적 욕구의 충족을 위하여 타인과 유대감, 동질감, 친밀감을 형성하는 취향, 행동, 관심 등 자신의 개인정보를 자발적으로 공개한다. 공개과정에서 자신이 책임 있는 선택을 하고 있다는 것을 인지하여, 타인의 개인정보에 대해서도 존중하여야 하며, 소셜 네트워크 서비스 이용자는 기본적으로 개인정보 제공자이지만, 또한 타인의 개인정보를 읽는 사람이기 때문에 한 개인이 수집자가 될 수도 있고, 침해자가 될 수도 있는 것을 인지해야 한다. 만약 개인정보에 관한 인격권이 침해된 경우, 사후적 구제로서 손해배상뿐만 아니라 사전 예방적 구제로서 금지청구권을 인정하는 것이 타당하다. 또한 고도인터넷시대에 걸맞은 사이버보안수준을 정립하기 위한 기술적・정책적 방안이 논의되어야 하고 그 결과가 법제도에 반영되어야 한다. 나아가 사이버보안시장을 활성화하고 좀 더 많은 전문 인력을 양성해야 하며, 체계화된 컨트롤타워를 설치하여 침해에 신속히 대응할 수 있는 방안을 수립함으로써 고도 인터넷범죄에 효율적으로 대처해야 한다. 아울러 피해를 미연에 방지할 수 있도록 사이버보안의 중요성과 필요성에 대하여 국민의 인식을 제고하도록 지속적으로 노력하고 아울러 정부차원의 교육 및 홍보가 한층 강화되어야 할 것이다.

영문 초록

Our daily lives are becoming convenient day by day thanks to the advancement of the internet environment. This internet environment has the advantages offering convenience and rationality in our lives, but the personal information could be leaked in the course of using it and the using process itself is exposed to the risk of hacking, and so even the worst situations would be worried that the convenience of civilization might be disguised as a deadly weapon of civilization. Social Network Service, extensively used to connect people, has great impact on society as it is that people can connect others on the other side of the earth in real time without any physical limitation. For this reason, SNS is widely used for marketing, advertising, and building relationships. However SNS has not only the bright side but dark side; SNS brings up issues over crime including infringement of personal information, exposure of privacy of others, involuntary information leakage such as current location while it provides good opportunities for people to exchange opinions and communicate. This article analyses the issues of private law on the personal information protection and remedies. Korean Personal Information Protection Act 2011 consists of some articles on the damage prevention, civil action, dispute mediation committee, etc. It need to be reformed in field of the protection certification system, foundation, and insurance, etc. in order to work effectively for injured parties and to lessen damage. In addition, in order to prevent the damage we must make efforts to raise national awareness about the importance and necessity of cyber security and the government should educate people about it.
